Dear Roost Enterprises Inc.:

This is to respond to your California Public Records Act (CPRA).

The University does not disclose compilations of student names, email
addresses, class levels, etc. The University is expressly prohibited under
the Information Practices Act (IPA) from disclosing mailing lists for
commercial purposes: An individual's name and address may not be
distributed for commercial purposes, sold, or rented by an agency unless
such action is specifically authorized by law. (Civil Code Section
1798.60) The Family Educational Rights and Privacy Act (FERPA) also protect
the privacy rights of individual students.

The privacy protections of both the IPA and FERPA are incorporated into the
CPRA pursuant to Government Code Section 6254(k), which exempts from
disclosure “records, the disclosure of which is exempted or prohibited
pursuant to federal or state law.”

The requested records are also exempt from disclosure pursuant to Government
Code Section 6254(c) which permits the withholding of "personnel, medical,
or similar files, the disclosure of which would constitute an unwarranted
invasion of personal privacy.” Furthermore, these requested records are
exempt from disclosure pursuant to Government Code Section 6255, which
permits the University to withhold records where the public interest in
withholding the information clearly outweighs the public interest in
disclosure. The purpose of the CPRA is to provide information about the
conduct of the University’s business, not to disclose
personal information about its students, or to subject its students to
communications unrelated to University business.
