All electronic communications, including full message threads and attachments, between UCLA professor Nelson Freimer and employees of Apple, his collaborator on the mental health study described in this 2020 news release: https://newsroom.ucla.edu/releases/ucla-launches-major-mental-health-study-to-discover-insights-about-depression. Apple employees use the email domain @apple.com.

Because this request is being made by a news organization on a matter of public interest, I ask that you waive any usually applicable fees. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

It is disappointing to hear that the review has not been completed. You wrote on October 15 that you estimated the documents would be ready by November 12. This estimate now appears to have been extremely inaccurate—you are now estimating completion by more than a month later. Can you tell me the reason for this reassessment?

We are in receipt of your email below. The California Public Records Act (“CPRA”) requires a public agency to make a determination within 10 days, plus an additional 14 days if needed, as to whether or not a request is seeking records that are publicly disclosable and, if so, to provide the estimated date that the records will be made available. Government Code section 6253(c). UCLA has met that requirement. In our October 15, 2021, letter to you, which was sent within 24 days of our receipt of your request, we notified you of our determination that responsive documents exist and provided you with an initial estimated availability date of November 12, 2021.

From time to time, UCLA must revise the estimated availability date it provides initially. This may be due to a variety of circumstances such as difficulties we encounter in obtaining the records, the volume of documents, or the time needed to review them. Each document we collect is carefully reviewed to determine whether it is indeed responsive to the request and, if so, whether the documents are, in whole or in part, subject to one or more of the exemptions to disclosure that exist under the CPRA, and redacted accordingly. We endeavor to provide an estimated availability date that is specific to each request and that is based on our understanding of the facts and circumstances of the request at the time the estimate is made. When those facts and circumstances change, we must sometimes change our estimate.

Your request seeks a substantial volume of documents. Based on the records we have collected thus far, and the work we have done to date, we currently estimate that we can provide you with records by December 17, 2021. We are working to meet this estimate and to begin producing documents to you on a rolling basis. We will advise you should anything change.

Please know that records requests are handled on a case-by-case basis and the amount of time needed to respond can depend on many factors, such as the number of document custodians involved, types and volume of records requested, location(s) of potentially responsive records (i.e. - in which department(s) and/or in an offsite storage facility), and the requisite review by our office of every page of potentially responsive documents for legal privilege (such as attorney-client, personal privacy, etc.). Further, please know that, besides processing all requests made under the California Public Records Act (“CPRA”), this office also processes subpoenas for UCLA records, along with records requests made pursuant to other statutes/Acts, and we have a limited amount of staff to handle all the many hundreds of such records requests/subpoenas received each year.

As potentially responsive records are collected, each and every document needs to be carefully reviewed to determine both whether it is indeed responsive to the request and/or if it or any material within it is subject to one or more of the exemptions to disclosure that exist under the CPRA, and then redacted accordingly. Additionally, we sometimes need to consult with others, such as University counsel, to further ensure that certain privileges/exemptions are being properly applied. The full process, as outlined above, is unfortunately rather time-consuming.
