Fred:
We have received the public records act request dated April 24, 2019,
requesting the following records:
- A copy of all documents related to the progress and reviews of the
progress and outcomes of the STEM Higher Education Project component of the
Georgia II MCC compact.
- A copy of the original proposals and bids for this project.
- A copy of any and all budget materials and plans for this project.
- A copy of any other Public Records requests concerning this grant and
(if any) the responsive materials.
- Staffing lists, including name, starting and ending dates, and salary.
Under Government Code section 6253, San Diego State University will conduct
a reasonable search for these records, and will make available for
your inspection
all responsive public records in its possession that are not subject to
exemption from disclosure under the Act (see, Sections 6254 and 6255).
The Public records Act allows for the protection of records that constitute
preliminary drafts and notes; records pertaining to pending litigation;
certain records contained in personnel files the disclosure of which would
constitute an unwarranted invasion of personal privacy; and records exempted
or prohibited from disclosure pursuant to federal or state law, including
but not limited to, the privacy provisions of the federal and state
constituents, the California Information Practices Act, and the provisions
of the Evidence Code relating to privilege. See Government Code section
6254 (a), (b), (c), and (k). In addition, Government Code section 6255
provides that an exemption exists where the public interest served in
disclosure of the record, including records that are in the deliberative
process. Records subject to these exemptions will not be disclosed.
Further, any records not deemed to be public records, as defined by the
Act, will not be disclosed.
SDSU has conducted a search for records and found no responsive documents.
The records that you are requesting are owned by SDSU Research Foundation.
The point of contact to send the PRA request is Lizette Najera at
lizette.najera@sdsu.edu.
Thank you.

Re: California Public Records Act Request: SDSU Georgia (MCC Grant)
Dear Mr. Zeifert:
We received your May 5, 2019 request under the Richard McKee Transparency
Act of 2011 for the following records:
- A copy of all documents related to the progress and reviews of the
progress and outcomes of the STEM Higher Education Project component of the
Georgia II MCC compact.
- A copy of the original proposals and bids for this project.
- A copy of any and all budget materials and plans for this project.
- A copy of any other Public Records requests concerning this grant and
(if any) the responsive materials.
- Staffing lists, including name, starting and ending dates, and salary.
SDSU Research Foundation has conducted a reasonable search for these
records under California Education Code §89914.5 and has determined that
your request either in whole or in part, seeks copies of disclosable public
records. Records that are protected by deliberative process; preliminary
drafts, notes, or inter/intra agency memoranda not retained in the ordinary
course of business; or records where the public interest served by not
disclosing the record clearly outweighs the public interest served by
disclosure, are exempt from disclosure and will not be provided. SDSU
Research Foundation will make available to you any that are public (Cal.
Educ. Code §§89914-89916.5; Cal. Govt. Code §§ 6254(a)(k) and 6255).
We will let you know when we have gathered all the records including
University-owned records. Please note this may take up to six weeks or
more since some of these records are in the country of Georgia. It will be
necessary to redact from them any personal and otherwise privileged or
exempt information before they can be made available to you.
If you wish to inspect the records at our offices, located at 5250
Campanile Drive, San Diego, California, you may contact me to schedule a
mutually convenient date and time. If you wish to receive copies instead,
SDSU Research Foundation may charge the direct cost of duplication (20
cents per page). We will advise you when the records are located as to the
exact number of pages upon which any charge will be based. We will require
full payment before we begin the redaction and duplication process.
Sincerely,
Lizette A. Najera

Good morning, Mr. Zeifert:
I am sorry for the delay in responding. I have been away on vacation as
well as some of my colleagues working on this. We have pulled over 1,200
documents and we are now in the process of reviewing them to see if any
information needs to be redacted. I estimate that this process will take a
few more weeks.
Best regards,
Lizette

Mr. Fred Zeifert,
Our response will be submitted today via upload to the muckrock link
provided in your email.
San Diego State University received your email request for documents on
April 24, 2019 and subsequently referred you to SDSU Research Foundation as
the entity with the majority of the responsive records. SDSU Research
Foundation received your May 5, 2019 request for the following
documentation:
"A copy of all documents related to the progress and reviews of the
progress and outcomes of the STEM Higher Education Project component of the
Georgia II MCC compact.
A copy of the original proposals and bids for this project.
A copy of any and all budget materials and plans for this project.
A copy of any other Public Records requests concerning this grant and (if
any) the responsive materials.
Staffing lists, including name, starting and ending dates, and salary."
Under California Education Code section 89914, San Diego State University
and SDSU Research Foundation conducted a reasonable search for the
requested records. The uploaded files are documents identified as
responsive to your request for both San Diego State University and San
Diego State University Research Foundation with the exception of
information for employees from the country of Georgia.
Personnel records are exempt from production where disclosure would
constitute an unwarranted invasion of privacy (including where providing it
would be a violation of law in the country where the individual is
employed) which is not outweighed by the public’s right to know. Cal. Govt.
Code §6254(c); Cal. Govt. Code §6255. Please refer to the SDSU Georgia
website for a list of staff: https://georgia.sdsu.edu/en/staff.
