This is in response to your request for records from the California Correctional Health Care Services (CCHCS) under the California Public Records Act (PRA), which was received in our office on June 02, 2021. Specifically, you requested the following:

Requesting releasable incident reports, post-fatality documentation, and other records relating to deaths in custody where cause of death was related to complications arising from COVID-19 infection from December 01, 2020 to most current.

For the portion of your request seeking other records relating to deaths in custody, there is an annual death review report made available on the CCHCS public website at the following link: https://cchcs.ca.gov/reports/. Please be advised that the most current report available is for 2019 whereas the report for 2020 has not been published. It is anticipated that the report will be available on the aforementioned web page at a later date. An additional resource which you may find responsive is the California Department of Corrections and Rehabilitation (CDCR) Population COVID-19 Tracking page which shows the number of inmate deaths due to COVID-19 by institution. This resource is located on CDCR’s public website at the following link: https://www.cdcr.ca.gov/covid19/population-status-tracking/.

For the remainder of your request pertaining to incident reports and post-fatality documentation, the information you are requesting is exempt from release via the California Public Records Act pursuant to Govt. Code §6254(c), which states, “[p]ersonnel, medical, or similar files, the disclosure of which would constitute an unwarranted invasion of personal privacy”. Additionally, the information is also exempt from release to the public pursuant to the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule.
