Pursuant to the California Public Records Act, I hereby request the following records:

Copies of all reports, lists, databases, or individual documents created since Jan. 1, 2016 that detail lawsuits brought against the city's police department and the outcome of lawsuits brought against the city's police department which includes the financial settlement. This should include any documentation mechanism your department uses to track lawsuits. It should also include any documents that your department submits to local, state, or federal agencies listing the number and/or status of lawsuits brought against the police department.

This request should be construed to include documents compiled quarterly, annually, or in other increments as well as documents or databases that contain responsive information over a longer time span.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

The City received your request for public records dated October 18, 2018 pursuant to the Public Records Act.

The City determined that it possesses certain identifiable records that fall within the scope of your request. You requested certain records which are statutorily exempt from disclosure. The records requested include reports and lists detailing lawsuits brought against the Stockton Police Department which fall within the attorney-client privilege and, therefore, are exempt from disclosure under Government Code section 6254(k). These records will not be provided for your review.

However, your request also seeks "individual documents" that detail lawsuits brought against the Stockton Police Department. The City is unclear as to what specific documents this request seeks to obtain. The City does retain copies of the complaints brought against the Stockton Police Department and can make copies of the responsive complaints available to you in accordance with the Government Code.

Please advise if you want copies of the complaints and the City will provide the records accordingly.

3. Race of Complainant (if available)
4. Nature of Lawsuit (excessive, force, etc)
5. Status of Case
6. Outcome of Case (Dismissed, Settlement Amount, etc.)

The City does not possess or maintain a list which includes all the information you have indicated in your email below. Also, as indicated in the City's response dated October 24, 2018, certain records that the City does maintain fall within the attorney-client privilege and, therefore, are exempt from disclosure under Government Code section 6254(k). These records will not be provided for your review.

Although you indicated individual documents were not required, the City can provide copies of the complaints. These records may provide much of the information sought.

Please advise if you want copies of the complaints and the City will provide the records accordingly.

However, will your office be able to compile a list of the other information requested above such as any and all settlements from civil lawsuits against the Stockton Police department between 2016-2018 alongside the case caption and date of filing?

Thank you for your response. The City is in the process of gathering and reviewing the requested complaints. We expect that the review will be completed by January 2, 2019. When the review is complete we will notify you that disclosable records are available for your review.

Regarding the compilation of a list containing settlements from civil lawsuits against the Stockton Police department between 2016-2018 and the case caption and date of filing, as previously indicated the City does not possess or maintain a list which includes this information. The City is not required to create new records and, therefore, this will not be provided.
