Pursuant to the California Public Records Act, I hereby request the following records:

- A copy of any and all contracts (including associated amendments and exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the provision of beverages or other goods in any facilities under the purview of this organization, including all activities and buildings associated with athletics, sports, dining services, or otherwise. If this agency does not have a contract with either of the named companies, please provide the equivalent agreement with the currently employed company.

- If the contract(s) was cancelled, any and all materials related to its cancellation.

- If the contract was cancelled, the statement from the university about cancellation.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Dear Carolyn Komatsoulis:
This is to acknowledge your California Public Records Act request for information regarding contracts, etc. awarded to Pepsi, Coca-Cola, or any subdivision thereof with the University of California. Appropriate UC Office of the President offices are being notified of your request. Records identified as responsive to your request will be reviewed, and made available for your access, in accordance with relevant law and University policy. The estimated date of production is eight weeks.

Although the requested records have not yet been fully gathered and reviewed, it is possible that the requested material may contain information exempt from disclosure pursuant to the California Public Records Act. However, this is not a determination that the requested records are necessarily exempt from disclosure. This office will provide you with a status update after the requested records have been thoroughly reviewed.

Please note that the University provides all vendors whose bidding documents are responsive to a CPRA request a courtesy notification that their records have been requested, and provides them the opportunity to seek an injunction or other means to prevent proprietary or trade secret information from being disclosed. It is our experience that these courtesy notifications will likely trigger subsequent CPRA requests from those other vendors for related bidding documents (i.e., your client's documents may also be subject to a similar, subsequent CPRA request.

For your information, the California Public Records Act allows agencies to make records available "upon payment of fees covering direct costs of duplication." (Government Code Section 6253(b)). In the event that copy costs are assessed for your CPRA request, prepayment is required before release of public records. Inquiries about this CPRA request should refer to CPRA number 18-2412.
