Pursuant to the California Public Records Act (California Government Code §§ 6250), I hereby request the following records:

Copies of all purchase orders received by the Department of General Services in connection with the State of California's Multiple Award Schedule contract with Palantir Technologies, contract no. 3-10-70-2793A.

Per the contract, copies of all purchase orders are to be submitted to:
Department of General Services
Procurement Division, Data Management Unit PO Box 989052, MS #2-203
West Sacramento, CA 95798-9052

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am responding on behalf of the Department of General Services (PD), Procurement Division (PD), pursuant to the provisions of the Public Records Act (Government Code Section 6250 et seq…). Your request dated January 20, 2017 was received in our office on January 20, 2017.

We understand your request to be for the copies of all purchase orders received by the Department of General Services in connection with the State of California's Multiple Award Schedule contract with Palantir Technologies, contract #3-10-70-2793A. According to DGS-PD staff we have no records to provide to your request, Our CMAS-SME informed us that the agencies do not send copies of their purchase orders issued against a CMAS to DGS/PD; therefore, you should contact the individual ordering agencies for copies of their purchase orders.

Mr. Nazar, thank you for looking into this, and for your response.

The CMAS contract states that ordering agencies "are required to send a copy of each CMAS purchase order" to DGS/PD Data Management Unit. I am including a verbatim excerpt from page 4 of the CMAS contract below. Would you please check back with your CMAS-SME on this? The purpose of this request was to identify the ordering agencies, and according to the contract, DGS/PD should have this information. If there have been no orders then I would expect there to be no responsive records, but the apparently-erroneous statement from the CMAS-SME raises concerns that the search may not have been done properly or at all.

2. Purchase Orders
State and Local Government agencies are required to send a copy of each CMAS purchase order to:
Department of General Services
Procurement Division, Data Management Unit
PO Box 989052, MS #2-203
West Sacramento, CA 95798-9052
(or via Interagency Mail Service #Z-1)
The agency is required to complete and distribute the order form. For services, the agency shall modify the information contained on the order to include the service period (start and end date), and the monthly cost (or other intermittent cost), and any other information pertinent to the services being provided. The cost for each line item should be included in the order, not just system totals.
The contractor must immediately reject orders that are not accurate. Discrepancies are to be negotiated and incorporated into the order prior to the products and services being delivered.

Hello Ansel,

I have made more enquiry with DGS-CMAS and attached MS-Word file is further evidence of no records and the following pragraph is the response I have received from Rhonda Smith, Program Manager.

"CMAS does not have any records in response to this request. Quarterly Reports for this CMAS do not reflect any sales to State or Local Agencies.

The language in the CMAS Ordering Instructions is outdated. State and Local Government agencies are no longer required to submit a copy of CMAS purchase orders. CMAS is in the process of updating our Ordering Instructions to reflect this change."
