The Department of California Highway Patrol (Department) received your request for public records pursuant to the California Public Records Act (CPRA) (Gov. Code, § 6250 et seq.).

In your request, dated August 14, 2017, you asked for:

· Policies, rules, and regulations for off duty officers

The Department is determining whether you seek copies of disclosable public records in the Department’s possession. Your request requires Department staff to search for, collect, and appropriately examine a voluminous amount of separate and distinct records that are demanded in a single request.
Accordingly, the Department is extending its 10-day response timeframe by an additional 14 days, as authorized by Government Code section 6253, subdivision (c).

Dear Mr. Waltman:

The Department of California Highway Patrol (Department) received your request for public records pursuant to the California Public Records Act (CPRA) (Gov. Code, § 6250 et seq.), dated August 14, 2017. On August 24, 2017, the Department requested a 14-day extension, to September 8, 2017.

In your request, dated August 14, 2017, you asked for documents relating to:

· Policies, rules, and regulations for off duty officers

· Complaints about off duty officers

The Department has determined that your request, in part, seeks copies of disclosable public records in the Department's possession.

Request Item (1). The Department has determined that it possesses public records that are responsive to your request, and has compiled a 31-page set of records for policies, rules, and regulations for off-duty officers contained in Highway Patrol Manual 10.3, Personnel Transactions Manual, Chapter 14, Inconsistent and Incompatible Activities.

Request Item (2). The request for complaints about off-duty officers is overbroad and burdensome in that the Department maintains no database searchable for these parameters. Even if the Department is able to identify responsive records, the records are subject to exemptions and are withheld on the following bases:

· Penal Code sections 832.5, § 832.7 and § 832.8

· Evidence Code sections 1040-1045, and 1151

· Government Code section 6254, subdivision (c)

· Government Code 6254 subdivision (k) which incorporates a person's individual right to privacy under the California Constitution, Art. I, Sec. §1

DUPLICATION FEE

In response to your request, the Department has compiled a 31-page set of records. To offset its duplication costs, the Department currently charges requestors a duplication fee of $0.30 per page for records. Therefore, if you wish to receive this set of records, please forward a check in the amount of $9.30 to the California Highway Patrol, Office of Community Outreach and Media Relations, P.O. Box 942898, Sacramento, CA 94298-0001 (Attention: Janelle Dunham). Please make the check payable to the "California Highway Patrol" and note file no. 2017-48 on the check. Alternatively, the records can be provided to you on a CD for $5. Once the Department receives this payment, these records will be prepared and mailed to you on an expedited basis.
