From: Conor Skelding

To Whom It May Concern:

Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, § 3(b)), I hereby request the following records:

Copies of all of James J. Valentini's course evaluations submitted by students—both statistical results and student comments—sorted by date, as well as the title of each course he taught or assisted-taught. I also seek any evaluations of Valentini submitted by supervising faculty or advisors.

According to columbia.edu, the website of his current employer, Valentini earned his Ph.D in Chemistry from UC Berkeley. [http://www.college.columbia.edu/about/dean/biography.php]

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Conor Skelding

Dear Mr. Skelding:

This will acknowledge and respond to your Public Records Act request below.
Appropriate offices have been notified and a search for responsive
documents is currently underway. Records identified as responsive to your
request will be reviewed, and made available for your access, in accordance
with relevant law and University policy.

Although the requested documents have not yet been fully gathered and
reviewed, it is possible that records you have requested may be protected
from disclosure under the Act. It is also possible that requested records
may contain information exempt from disclosure under the Act. However, this
is not a determination that the requested records are necessarily exempt
from disclosure
. We will provide you with a status update after the requested records
have been thoroughly reviewed.

Please note that the California Public Records Act allows agencies to make
records available “upon payment of fees covering direct costs of
duplication.” (Government Code Section 6253(b)). The charge for disclosable
records are normally provided at a cost of $0.20 per page for scanned or
paper copy
.

I
n addition, Government Code Section 6253.9(b) provides that requester
s
shall bear the cost of producing a copy of the record, including the cost
to construct a record, and the cost of programming and computer services
necessary to produce a copy of the record when either of the following
applies:

(1) In order to comply with the provisions of subdivision (a), the public
agency would be required to produce a copy of an electronic record and the
record is one that is produced only at otherwise regularly scheduled
intervals.

(2) The request would require data compilation, extraction, or programming
to produce the record.

Pre-payment for all scanning/copying and programming costs is required
before release of public records. We will notify you if there is an
associated cost for disclosable records requiring scanning/copying and/or
programming.

Regarding your request that we grant a waiver of
c
fees

, the University does not generally waive such costs.

Regards,

Liane Ko
Public Records Coordinator
