Please provide a copy of the educational records retention schedule and guidelines for California, specifically including information for individual students' "permanent records", and individual schools' attendance records, directories and class lists, "all-school census" records, and other lists of students who attended specific schools.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Ms. Schreier Ganz,

The California Department of Education received your Public Records Act request on March 8, 2016. The request was referred to me for response. In that request, you stated:

"Please provide a copy of the educational records retention schedule and guidelines for California, specifically including information for individual students' "permanent records", and individual schools' attendance records, directories and class lists, "all-school census" records, and other lists of students who attended specific schools."

I construe your request to be seeking records that reflect the guidelines and policies for the retention of the educational records that are maintained by California's K-12 public schools. In response to your request, the CDE responds as follows:

I cannot think of a specific "record" or set of records responsive to this request. The CDE instructs public schools to follow the guidelines and policies that have been adopted in the Education Code, as well as the guidelines that have been adopted by the CDE, and approved by the Office of Administrative Law, set forth in Title 5 of the California Code of Regulations pertaining to the retention and treatment of educational records by local educational agencies. Among the specific sections of law applicable to pupil record retention in California K-12 public schools is Division 3, Part 21, Chapter 1, Article 8, starting at Section 35250 as well as Division 4, Part 27, Chapter 6, starting at section 49060, of the California Education Code, as well as Chapter 2, Subchapter 2, Article 3 (starting at sections 430-438) and Chapter 16, Subchapter 2 (starting with Sections 16020-16027) of Title 5, California Code of Regulations.
