To Whom It May Concern:

Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, § 3(b)), I hereby request the following records:

All emails released in response to PRA 15-R118, submitted to the CHP in March 2015 as two separate requests: one for "copies of any and all emails sent to this email addy, [sic] 30Media@chp.ca.gov, from Dec. 7, 2014 through today's date," and one for "copies of all emails sent or received by CHP Chief of Golden Gate Division Avery A. Browne, from December 7, 2014 through December 12, 2014."

In a response letter sent to the requester, CHP special counsel indicated that two disks of material had been prepared for release.

A portion of these emails were also cited in an article in the East Bay Express on April 15, 2015: http://www.eastbayexpress.com/oakland/counter-terrorism-officials-helped-track-black-lives-matter-protesters/Content?oid=4247605

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Shawn Musgrave

Dear Mr. Musgrave:

Your request has been referred to me for handling, and I have reviewed it pursuant to the California Public Records Act (CPRA) (Gov. Code, § 6250 et seq.). The CPRA is California’s counterpart to the federal Freedom of Information Act.

In your request, you ask for the following: (1) Copies of all e-mails sent to 30Media@chp.ca.gov<mailto:30Media@chp.ca.gov> from December 7, 2014 through May 5, 2015; and (2) copies of all e-mails sent or received by Assistant Commissioner A. Browne (formerly Chief of Golden Gate Division) from December 7, 2014 through December 12, 2014.

The Department of California Highway Patrol (Department) has compiled records that are responsive to this request. If you wish to receive this set of records, please forward a check in the amount of $10.00 to the California Highway Patrol, P.O. Box 942898, Sacramento, CA 94298-0001 (Attention: California Public Records Act Coordinator). Please make the check payable to the “California Highway Patrol.” This payment will offset the Department’s duplication costs. Once the Department receives this payment, these records will be immediately mailed to you.

If the above restatement of your CPRA request is not accurate, please provide clarification at your first opportunity.

If you have any questions related to this correspondence, please direct them to my attention.

Sincerely,

Suzanne R. Moser
