Re: Request for Information under the California Public Records Act

Dear Benjamin Allen:

I write to acknowledge receipt of your requests, received in our office on
January 2, 2019, for the following information:

[1] A copy of any and all contracts (including associated amendments and
exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the
provision of beverages or other goods in any facilities (cafeteria,
athletic, academic, recreational, student, etc.) under the purview of this
organization, including all activities and buildings associated with
athletics, sports, dining services, or otherwise. If this agency does not
have a contract with either of the named companies, please provide the
equivalent agreement with the currently employed company.

[2] If a contract(s) with Pepsi, Coca-Cola, or any subdivision thereof has
been cancelled, please provide any and all materials related to its
cancellation.

[3] If a contract with Pepsi, Coca-Cola, or any subdivision thereof has
been cancelled, please provide the statement from the university about
cancellation."

A search for the information is underway. All records identified as
responsive to your request will be reviewed, and made available for your
access, in accordance with relevant law and University policy.

Although the requested records have not yet been fully gathered and
reviewed, it is possible the requested material may contain information
exempt from disclosure pursuant to the California Public Records Act
(CPRA). However, this is not a determination that the information is
necessarily exempt from disclosure.

We anticipate records will be available for inspection within 10 weeks. Our
office will contact you as soon as the records are assembled. While you may
inspect the records on campus at no charge during a mutually convenient
appointment time, please note that the University is entitled to charge for
the cost of document duplication for any copies you may wish to retain.

If you have questions concerning UCSC’s implementation of the CPRA please
feel free to contact Information Practices at (831) 459-4003 or via email
pra@ucsc.edu.

Re: Requests for Information under the California Public Records Act

Dear Benjamin C Allen:

I write in response to your January 2, 2019 requests for information under
the provisions of the California Public Records Act (CPRA).

electronic copies of University of California, Santa Cruz (UCSC) records
responding to your request for:

“ - A copy of any and all contracts (including associated amendments and
exhibits) awarded to Pepsi, Coca-Cola, or any subdivision thereof, for the
provision of beverages or other goods in any facilities (cafeteria,
athletic, academic, recreational, student, etc.) under the purview of this

Please note this link is clickable one time only for download to your
preferred storage location (e.g. save to your desktop) and will expire on May
3, 2019.

Although the CPRA permits the University to collect duplication fees at the
rate of $0.20 per page for all records provided, our process allows a fee
waiver for the production of documents previously disclosed in response to
other CPRA requests. Therefore, we are waiving the fees associated with the
responsive documents. However, the University reserves the right to charge
duplication fees in the future as appropriate.

After a reasonable search, UCSC has determined that no records exist
responding to your requests for:

“- If a contract(s) with Pepsi, Coca-Cola, or any subdivision thereof has
been cancelled, please provide any and all materials related to its
cancellation.

- If a contract with Pepsi, Coca-Cola, or any subdivision thereof has been
cancelled, please provide the statement from the university about
cancellation.”

UCSC now considers this request fulfilled and will close the file. If you
have questions concerning UCSC’s implementation of the CPRA please contact
Information Practices at (831) 459-4003 or pra@ucsc.edu.

Sincerely,

Tyler Burke
