The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Dustan Batton,

I am responding to your request for public documents. The Natural Resources Agency ("Agency") has determined that it will provide you with responsive documents, subject to certain exemptions and qualifications, as explained. Please note, the Agency will not review the records of any other Boards, Departments, Commissions, or any other bodies that are separate legal entities to the Agency and maintain their own files. Additionally, the Agency will not produce documents already in the public domain.

The Agency will exempt/redact any communications that reveal its deliberative process, attorney-client work product, or other applicable exemptions-which I will clearly articulate upon the production date herein listed. Documents or information redacted or withheld under the deliberative process privilege will be exempted under the public interest balancing test set forth in Government Code §6255 and Evidence Code §1040. To prevent injury to the public interest, my client will exempt/redact only those email communications and other documents in which the public interest served by maintaining confidentiality clearly outweighs the public interest disclosure. (See Gov. Code, §6255 and Evid. Code, §1040.)

The Agency understands and takes seriously the requirements articulated by the California Supreme Court that each and every entry considered for redaction and/or exemption under the deliberative process exemption must clearly outweigh the interest of disclosure. (See Times Mirror v. Superior Court, supra, 53 Cal. 3d. 1325.) The Agency will only redact those entries that meet this standard.

The Agency will endeavor to make available responsive, non-exempt records contained within its files by March 28. If I can produce documents sooner than this date, I certainly will. I will do my best to make them electronically available for you and waive the fee, unless you prefer copies.

The Agency charges $0.15 per page for its direct cost of copying. The fee for copying reflects the Agency's direct photocopying costs, which include the cost of running the copying machine and the expense of the person operating it. The Agency fee does not include the cost of retrieving, inspecting, and handling the records, which is prohibited by the Public Records Act.
