Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, § 3(b)), I hereby request the following records:

A list of any items confiscated Jan. 1, 2013 by CDFA employees or on behalf of the CDFA at the California state border checkpoints.

I also request that all fees be waived as I am a journalist -- employed by MuckRock and the Boston Globe -- and intend to use the requested documents to educate the public and not for commercial purposes.

I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Hello, Mr. Feathers,

We are replying to your e-mail request, below, made under the Freedom of Information Act, a federal statute applicable to federal agencies. California state agencies are governed by the California Public Records Act (PRA) [CA Gov. Code §§ 6250, et seq.]. Therefore, the Department is responding in accord with the California statutes.
In response to your request, attached please find an Excel spreadsheet listing the commodities confiscated by the CDFA’s Pest Exclusion Branch on January 1, 2013. The items confiscated can be found under Column U on the spreadsheet.

The Department’s fees for processing PRA requests consist of twenty cents (20¢) per page for copies -- for both paper and electronic copies -- and actual packaging and postage, if copies are mailed. However, the Department waives such costs when they amount to five dollars ($5) and under, as is the case in this instance.
