To Whom it May Concern,

As noted in my original request, I am looking not just for the potential impacts of the exposure of PII via a public facing website with zero controls on the raw data, but all communications leading up to that exposure and afterward. There is an overriding public interest in knowing exactly which governmental employees and elected officials made decisions, including the decision to launch that website, as well as what was communicated after the exposure.

Mr. Shaw,

As described in the letters the Department sent to you on July 22 and October 3, 2022, we must deny this PRA request. The independent investigation by outside counsel is still ongoing. The review team is investigating how this exposure occurred, supervising an outside forensic cyber expert to examine the data and what happened from a digital perspective, and reviewing the Department's policies and practices. Outside counsel and the forensic cyber expert are continuing to review documents, analyze data, and conducting interviews of relevant personnel. In response to a PRA request, the Department may withhold certain records when the public interest served by not disclosing the records clearly outweighs the public interest served by disclosure of the record. (Gov. Code, § 6255.)

At this time, as the investigation is ongoing, the public interest in disclosure of the records you requested is clearly outweighed by the public interest in facilitating an accurate and thorough investigation. (Id.) When the investigation is complete, the Department will report the investigative findings to the public. We anticipate these findings will cover how the incident occurred and the steps the Department is taking to ensure that something like this does not happen again. We expect the investigation to be complete in the coming months.

Hello,

As stated before, I’m not interested in the conclusions reached by an agency’s chosen investigators, and I’m sure the DOJ wouldn’t accept a corporation repeatedlyinvestigating itself and finding itself blameless. I want the communications before and after the release of information, again, not the investigation’s conclusions. If the investigators are at all qualified, their first step would be a full audit of those communications, including documenting and cataloging those communications. I want those records, without color from investigators.

Further, I’d request a copy of all internal communications related to my request. Surely an organization whose own website touts “A transparency initiative led by the California Department of Justice that publishes criminal justice data so we can understand how we are doing, hold ourselves accountable, and improve public policy to make California safer.” wouldn’t hide records and information from the public, right?
