Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, § 3(b)), I hereby request the following records:

-The current memorandum of agreement (MOA) or memorandum of understanding (MOU) with the Defense Logistics Agency, Disposition Services regarding the 1033 equipment surplus program administered by the DLA Law Enforcement Support Office

-The annual inventory form required to be completed by the state coordinator of the 1033 program

According to the DLA FAQ page regarding the 1033 program, Cal OES is the agency in charge of coordinating the 1033 program for the state. See http://www.dispositionservices.dla.mil/leso/Pages/StateCoordinatorList.aspx

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

We are in receipt of your Public Records Act request for information concerning the 1033 program. As you can imagine, we have received many of these requests over the past several days. We are currently in the process of gathering all of the information in our possession that would be responsive to each of these requests. It is the goal of the California Governor’s Office of Emergency Services to operate transparently and to provide to the public as much information as the law permits us to provide. It is our intention to release to the public all disclosable information via our website as quickly as possible. However, given the volume of requests and the amount of information that must be reviewed, we need to invoke the 14 day extension as permitted under the Public Records Act. Please note that this a snapshot of the inventory from the Law Enforcement Support Office, a federal agency, and it is not maintained or updated by Cal OES.

Also, all non-tactical equipment, as determined by the Federal Department of Defense, automatically drops off of this inventory after a year. Therefore, non-tactical items acquired more than a year ago will not be reflected on this inventory. We are unable to provide historical or archived information for these items. Lastly, please also note that certain fields were redacted from this spreadsheet, as indicated on the website.

In many instances, the information we have posted far exceeds the scope of the request. Having produced this information, we will now consider your Public Records Act request to be closed. Thank you very much.

I would note that more than 26 states have posted the full state property book without redaction -- the redaction of NSN, in particular, is unusual. Please confirm whether I will need to appeal to obtain this field as well as any remaining fields.
