Pursuant to the Ohio Open Records Law, I hereby request the following records:

1) Copies of usage statistics/reports from the university's Proctorio software documenting:
a) How many times the proctoring software has been used since Jan. 1, 2020
b) How many times the software has flagged activity as suspicious since Jan. 1, 2020

The Proctorio software allows for automatic generation of these reports, as demonstrated by the attached document. If it is not possible to generate reports for a specific time frame starting on Jan. 1, 2020, I ask that you provide weekly, monthly, or academic year reports covering 2019 and as much of 2020 as is possible.

I ask that all fees be waived as I am a journalist and I intend to use the requested records to publish articles in the public interest, and not for any commercial purpose.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Our records indicate that we received your public records request last
Thursday, 10/15/2020 not on 10/2/2020. We have been working to locate
responsive documents. Please be aware that your request is not a proper
public records request as it seeks information – not records. A compilation
of information must already exist in public records before access will be
required. See *State ex rel. Scanlon v. Deters, *(1989) 45 Ohio State 3d
376. A public office is not required to search a database for information
and compile or summarize to create new records. (State ex rel. White v.
Goldsberry (1999) 85 Ohio State 3d 153).

Miami University is not able to generate a report that contains all the
information that you have requested. I have included a screen shot of our
admin dashboard of a sample of the aggregate data we have access to on our
end.

Occasionally, Proctorio has provided us with reports that are similar to
the one you sent us to use as an example. I have attached the most recent
report the University received which spans October 2019 to October 12,
2020. We are searching our records to see if we have any other reports that
Proctorio may have sent to us during 2019. We will forward additional
records if we are able to locate them. Please be aware that we do not have
a report for how many times the software has flagged activity as suspicious
since Jan. 1, 2020.
