Subject matter listing (Buffalo Mayor's Office)

To Whom It May Concern:

Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

A copy of the current list by subject matter, of all records in the possession of the agency.

Per NEW YORK PUBLIC OFFICERS LAW, ARTICLE 6, Section 87(3):

"Each agency shall maintain:

[....]

(c) a reasonably detailed current list by subject matter, of all records in the possession of the agency, whether or not available under this article. Each agency shall update its subject matter list annually, and the date of the most recent update shall be conspicuously indicated on the list."

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Thank you for your correspondence.

We have no record that this letter regarding the FOIL for the subject matter listing maintained by the Mayor's Office was ever received. However, on May 6, 2015, we sent the following email to follow up, given the lack of response by your office:

"Hello -

Checking to confirm that this FOIL request for the subject matter listing maintained by the Mayor's Office has been received and is being processed. It was submitted by email several weeks ago but has yet to be acknowledged.

Thank you."

That email clearly indicated that this request is for the subject matter listing maintained by the Mayor's Office. Furthermore, the request identifies a specific document that the FOIL statute itself requires New York government agencies to maintain. As such, it is a fully adequate FOIL request.

In light of the above, please fulfill this request immediately.
