Pursuant to the New York Freedom of Information Law, I hereby request the following records:
The personnel file for the department covering active and retired personnel from 2010-to the present including the following fields:
- officer first name
- officer last name
- officer middle name
- officer age
- officer race
- officer sex
- officer rank
- officer badge number
- officer emp id
- years on force
- hired date
- retired or fired date
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

The City of Buffalo Police Department is in receipt of your Freedom of
Information Law request. Please allow this letter to serve as an
acknowledgment of your request pursuant to New York State Public Officer’s
Law, Section 89, entitled Freedom of Information Law.
Please be advised that your request is being processed by the Police
Department. BPD will then conduct a diligent search to determine whether we
are in possession of the record for which you seek access. Due to the large
number of requests the department is currently handling,please allow (45)
business days for a determination regarding your request for records.
Please be advised also that access to Public Officers Law, 87(1)(b), the
costs for copied material is $0.25 per page not in the access of 9”x14”.

The City of Buffalo has reviewed your recent Freedom of Information Law
(FOIL) request for Buffalo Police Department (BPD) records. You seek: “All
‘active and retired personnel files 2010- present’ as defined by FOIL 86,
pertaining to the operations of the Buffalo Police Department,” including
records such as complaints, transcripts, and written opinions. You request
an estimate of costs in advance of fulfillment. Please be advised the
Public Officers Law provides that the City may charge for costs such as
employee time when at least two hours of time is needed to prepare
requested records (see Public Officers Law §87(1)(c)). Your request will
take at least two hours to prepare. The City will need to review the
numerous records you seek and make necessary redactions (see Public
Officers Law §§ 87(4-a),87(4-b)).
It is difficult for the City to estimate the full costs necessary to
fulfill your request at thistime, particularly because your request is so
voluminous. We suggest that you initially request a smaller portion of
records so that the City may more accurately estimate the employee time
needed. Going forward, you may then provide a series of advance deposits to
reimburse the City for the cost of processing portions of the records you
seek, which the City can provide on a
rolling basis.
Please let me know if you would like to further discuss this matter before
submitting a smaller request for a portion of the records you seek.
Please be advised that you have the right to appeal any denial contained
herein in writing within thirty (30) days. Appeals must be directed to
Timothy A Ball, Corporation Counsel, City of Buffalo Law Department, 1100
City Hall, Buffalo NY 14202.
