1. All law enforcement disciplinary records as defined in Section 86 of the Public Officers Law related or referring to: Aaron Torgalski, Robert McCabe, Ronald J. Ammerman, Todd C. McAlister, Nicholas J. Parisi, Joseph Acquino, Justin Tedesco, Elnur Karadshaev, and Joseph Meli.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Re: Foil Request Discipline Files

The City of Buffalo Police Department (BPD) received your recent Freedom of
Information Law (“FOIL”) requests seeking records pertaining to discipline
files. Please be advised that the City has not yet provided the records
you seek due to the large number of FOIL requests that the City is
currently handling as well as the ongoing health crisis and working
restrictions.

Public Officers Law section 89(3)(a) provides: “if circumstances prevent
disclosure to the person requesting the record or records within twenty
business days from the date of the acknowledgement of the receipt of the
request, the agency shall state, in writing, both the reason for the
inability to grant the request within twenty business days and a date
certain within a reasonable period, depending on the circumstances, when
the request will be granted in whole or in part.”

I am therefore writing to advise you that the BPD will respond to your FOIL
request by April 20, 2021. Said date represents a reasonable period within
which the BPD will be able to provide the records you seek.

The City of Buffalo Police Department is in receipt of your Freedom of
Information Law request. Please allow this letter to serve as an
acknowledgment of your request pursuant to New York State Public Officer’s
Law, Section 89, entitled Freedom of Information Law.

Please be advised that your request is being processed by the Police
Department. BPD will then conduct a diligent search to determine whether we
are in possession of the record for which you seek access. Due to the large
number of requests the department is currently handling, please allow (45)
business days for a determination regarding your request for records.

Please be advised also that access to Public Officers Law, 87(1)(b), the
costs for copied material is $0.25 per page not in the access of 9”x14”.

The BPD has researched your request for information pertaining to Officer

Meli, James C. and James D. O'Donnell. Your request resulted in (470)
