To Whom It May Concern:

Pursuant to the Connecticut Freedom of Information Act, I hereby request the following records:

1) Minutes of the Branford Board of Selectman’s meeting documenting the appointment of Gary Zielinski as Branford Tree Warden.
2) A statement of the amount of the stipend awarded to Gary Zielinski in payment for fulfillment of duties as Branford Tree Warden.
3) A statement on the distinction between his duties as tree warden and his duties as town highway supervisor and why he is receiving extra compensation.
4) A statement of the amount of Gary Zielinski’s 2021-2022 salary as highway supervisor exclusive of the above stipend.
5) A copy of the Connecticut State certification confirming that Gary Zielinski completed all state requirements for the position of Branford Tree Warden specified in Section 23-59a of the Connecticut General Statutes.
6) A statement confirming that Gary Zielinski is not registered in the state of Connecticut as a professional arborist.
7) A statement confirming that in compliance with Branford code Sec. 16.8, titled Branford Tree Ordinance, the town is required to contract the services of a Connecticut Licensed Arborist to work in a consulting role with the Tree Warden, who is not a professional arborist.
8) A copy of town contracts with state licensed arborists working with the Branford Tree Warden on trees along Leetes Island Road in the past 5 years.

I also request that, if possible and pursuant to Conn. Gen. Stat. § 1-212(d), fees be waived as I believe this request is in the public interest and not made for commercial gain. The requested documents will be processed by a representative of the news media/press and made available to the public at MuckRock.com.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 4 business days, as the statute requires.

Please be advised that a response to the request was mailed via USPS and receipt was acknowledged on November 19, 2022. A follow up request was also sent directly to the Human Resources Department on December 19, 2022 and a response to that request was emailed on December 22, 2022.

The town has forwarded all responsive documents and considers this request closed.

Please post publicly all responses to this Muckrock FOIA request, in full compliance with the spirit of the FOIA.

As per your mailed response, the town isn't required to respond to requests for "statements" only public records.

Semantic subtleties aside, the following requested public record received no response:
5) A copy of the Connecticut State certification confirming that Gary Zielinski completed all state requirements for the position of Branford Tree Warden specified in Section 23-59a of the Connecticut General Statutes.

To aid in your efforts to make all responses public, I have attached your response to the Human Resources request of December 22, 2022 and a partial copy of the mailed response of November 19,2022.

All responses to date imply that Branford does not have a state authorized tree warden.
