Your request seeks all public records requests received by the District from January 1, 2010 through November 4, 2021, as well as a complete electronic copy of the District’s responses to those requests. You have requested “electronic production of all electronic records in the original NATIVE format for each record.” The vast majority of records the District has disclosed in response to public records requests since 2010 have not been produced in native format, and instead were produced in formats such as .pdf or hard-copy. And as noted earlier, you have requested “a complete electronic copy of the District’s Responses” to public records requests during the time period in question, and such responses typically did not contain native format records. In light of this conflict, the District interprets your request as seeking the District’s previous disclosure communications in their native format when they were sent electronically, recognizing that those disclosure communications will often contain non-native files. For example, the District would produce to you the native format email of its response to a given public records request, which may include attached responsive records in pdf format that were actually produced to a requestor. Please let me know if you disagree with this interpretation of your request. Next, please be aware that the District may no longer possess copies of older public records requests and/or District responses. In that event, the District would be unable to disclose copies of such requests and responses. Our initial review suggests that the District retains such records dating back approximately three to four years. Per RCW 42.56.120, the District charges the following fees for copies of records: 1. Fifteen cents per page for photocopies of public records, printed copies of electronic public records when requested by the person requesting records, or for the use of agency equipment to photocopy public records; 2. Ten cents per page for public records scanned into an electronic format or for the use of District equipment to scan the records; 3. Five cents per each four electronic files or attachment uploaded to email, cloud-based data storage service, or other means of electronic delivery; 4. Ten cents per gigabyte for the transmission of public records in an electronic format or for the use of District equipment to send the records electronically; and 5. The actual cost of any digital storage media or device provided by the District, the actual cost of any container or envelope used to mail the copies to the requestor, and the actual postage or delivery charge. Any applicable copying costs must be received by the District before the District discloses records. Additionally, RCW 42.56.120 authorizes the District to require a deposit of up to ten percent of the total estimated costs of providing copies for a request. The District has not yet had an opportunity to determine how many responsive records there will be, or what the total estimated cost of fulfilling the request will be. Prior to providing a first installment of records for this request, we will contact you to let you know the total estimated cost and the deposit amount due. The Public Records Act  authorizes the District to charge requestors for the copying costs for a public record request, including, but not limited to, the following: (ii) Ten cents per page for public records scanned into an electronic format or for the use of agency equipment to scan the records; (iii) Five cents per each four electronic files or attachment uploaded to email, cloud-based data storage service, or other means of electronic delivery; and (iv) Ten cents per gigabyte for the transmission of public records in an electronic format or for the use of agency equipment to send the records electronically. Is it the District's position a full fee deposit for the entire records request must be received prior to processing the first installment? Please confirm. RCW 42.56.120(f) (4) is clear regarding fees and estimates for installment records. We are requesting a fee estimate for the 1st installment only.

If the District continues with the misguided position that a deposit for all requested records is required prior to beginning the processing and fulfillment of a first installment of records, RCW and case law on this matter is clear and well settled.

Option for relief of an agency's action are outlined in RCW 42.56.550.

RCW 42.56.120(4), the statute that authorizes a ten percent deposit, states, “An agency may require a deposit in an amount not to exceed ten percent of the estimated cost of providing copies for a request, including a customized service charge.” The statute in no way prohibits an agency from requiring a deposit for the entire request to be paid upfront, and does not require that a deposit can only be charged for each installment. The WACs promulgated by the Attorney General’s Office expre ssly support this inte rpretation: (1) Copying deposit. An agency may charge a deposit of up to ten percent of the estimated copying costs of an entire request, including a customized service charge, before beginning to copy the records. RCW 42.56.120(4). The estimate must be reasonable. An agency can require the payment of the deposit before copying an installment of the records or the entire request. The deposit applies to the records selected for copying by the requestor, not all the records made available for inspection. An agency is not required to charge a deposit. An agency might find a deposit burdensome for small requests where the deposit might be only a few dollars. Any unused deposit must be refunded to the requestor. When copying is completed, the agency can require the payment of the remainder of the copying charges before providing the records. For example, a requestor makes a request for records that comprise one box of paper documents. The requestor selects the entire box for copying. The agency estimates that the box contains three thousand pages of records. The agency charges fifteen cents per page so the cost would be three hundred fifty dollars. The agency obtains a ten percent deposit of thirty-five dollars and then begins to copy the records. The total number of pages turns out to be two thousand nine hundred so the total cost is two hundred ninety dollars. The thirty-five dollar deposit is credited to the two hundred ninety dollars. The agency requires payment of the remaining amount before providing the records to the requestor. (2) Copying charges for each installment. If an agency provides records in installments, the agency may charge and collect all applicable copying fees (not just the ten percent deposit) for each installment, unless the agency is assessing a two-dollar flat fee. RCW 42.56.120. The agency may agree to provide an installment without first receiving payment for that installment. WAC 44-14-07006 (emphasis added). See also WAC 44-14-070(5) (“Before beginning to make the copies or processing a customized service, the public records officer or designee may require a deposit of up to ten percent of the estimated costs of copying all the records selected by the requestor”) (emphasis added). We have not identified any case law rebutting the shared position of the Northshore School District and the Attorney General’s Office described above. That said, if you are aware of any such case law, we would be happy to review it. Finally, as mentioned in our earlier communications, once we have received the required deposit of $78.42, we will assemble a first installment. The purpose of this letter is to let you know we have not heard from you regarding your deposit payment. In our February 4, 2022 letter, we communicated we would close your request if we did not hear from you. In our March 8, 2022 letter to you we communicated that we would close your request if we did not hear from you by April 7, 2022. It is April 12, 2022 and we are notifying you that we will close your request as of April 22, 2022 if we do not receive the deposit. You have requested “a complete electronic copy of the entire .pst email archive” for five specified email addresses. A .pst file is an electronic container that can hold preexisting electronic files. For example, the official Microsoft<https://support.microsoft.com/en-us/office/introduction-to-outlook-data-files-pst-and-ost-222eaf92-a995-45d9-bde2-f331f60e2790> website describes a .pst as a file that “contains your messages and other Outlook items and is saved on your computer.” The five .pst files requested here are containers that contain hundreds of thousands of files.

It would be technically feasible to promptly export and provide you with the five requested .pst files in their entirety. However, doing so would violate numerous confidentiality laws, given that many of the hundreds of thousands of emails contained within the .psts contain confidential information, including but not limited to student information protected by the Family Educational Rights and Privacy Act (FERPA) and employee medical information protected by the Americans with Disabilities Act (ADA). As a result, as with all public records requests, the District must individually review each of the hundreds of thousands of files contained within the five .psts to determine whether the individual files contain exempt information.

If a file contained within a .pst does contain exempt information, it must be redacted (or in limited circumstances, withheld). To redact a file, the District must first convert it to a .pdf. The District is able to then produce the redacted .pdf, but cannot produce the original file as part of the .pst which originally contained the file, because doing so would necessitate providing the unredacted file. Washington courts have recognized that where it is not possible to provide a record in the requestor’s desired format because redacting the record changes its format, an agency can produce the record in the new format. See Mitchell v. State Department of Corrections, 164 Wn. App. 597 (2011) (agency was not required to produce records in electronic format when redactions were required and the agency had to print the records to make the redactions); Berg v. City of Kent, No. 81253-0-I (2021) (agency was not required to provide exempt electronic records in native format where redactions necessitated producing records in non-native format).

As a result, although it is technically feasible to quickly export a .pst file containing hundreds of thousands of records, such a file will not be ready for disclosure for many months or years. When the records are ready for disclosure, we will be able to produce the non-exempt records in their native formats inside one of the five .psts, but all exempt records will need to be produced as redacted pdfs, and will need to be produced outside of the .psts.

Finally, our position regarding applicable copying charges remains the same. In your 1/9/2024 email you confirmed you want records produced for the time span of 1/1/2015 - 11/17/2023 instead of 1/1/2015 - 2/01/2023. Our search for records from that expanded date range identified approximately 716,000 responsive files within the five email accounts. When those files get exported to a .pst, which is a container akin to a folder that “contains your messages and other Outlook items,” they still exist as files. In other words, if we produce a .pst containing 100,000 files, we will still be producing 100,000 files—not just one file. As a result, consistent with Procedure 4040P and RCW 42.56.120, the District charges a copying cost of five cents per each four electronic files or attachments. The total cost of these records will thus be approximately $8,950.00.

Consistent with Procedure 4040P and RCW 42.56.120, a ten percent deposit of $895.00 is due from you before any records will be made available. Please reach out to me to coordinate payment. If you plan to mail a check, please mark it attention: Public Records Officer, JoLynn Berge.

Thank you for explaining the basis of your initial deposit estimate.

Please make the following adjustments, and recalculate your deposit estimate:

I understand the District’s desire to redact information considered exempt from within each of the 5 .pst files. However, once redactions have taken place, the District has the generally commercially available ability to re-constitute the .pst files for fee calculation and production or, in the alternative to provide the redacted .pdf files in an alternative, generally commercially available format that is much more efficient and/or cost effective than the production of 716,000 individual .pdf files.

As you should be aware, your agency is not permitted to charge the public fees for time and resources spent redacting requested public records.

I will accept either of the two (2) alternative generally commercially available formats for the production of the five (5) District redacted .pst files:

1. After redaction, the District may .zip or “repack” all redacted materials into the fewest .zip digital file format containers prior to final fee calculation and production. Utilizing the FREE, generally commercially available format .zip format would result in the production of possibly a few dozen .zip files rather than the production of 716,000 non-responsive “responsive files” you have described. These 716,000 “responsive files” were *not* requested, rather 5 specific .pst files were requested.

2. If for some reason the District chooses not to utilize the FREE .zip file format for production of the 5 redacted/transformed .pst files, the District has the option of producing the redacted .pdf files as an adobe acrobat .pdf portfolio. A .pdf portfolio is defined as follows:

The .pdf portfolio is an archive of .pdf files stored inside a single document, with a PDF extension. PDF portfolios are commonly used for storing emails exported from email server software including .pst files. Every file inside a PDF Portfolio may contain associated metadata information.

The .pdf portfolio format is a FREE generally commercially available format available to the District in it’s regular operations of redacting records to the .pdf file format. The .pdf portfolio archive is a .pdf file document itself.

Similar to the .zip file format, a .pdf portfolio file format would result in the production of possibly a few dozen .zip files rather than the 716,000 non-responsive “responsive files” you previously described. The 716,000 “responsive files” were *not* requested, rather 5 identified .pst files were requested.

Please recalculate the District’s initial public records deposit estimate of $8,950.00 based on the .zip or .pdf portfolio files formats. Again, both formats are generally commercially available formats utilized by the District in the District’s regular daily operations that will result in the production of just a few dozen digital files at a greatly reduced cost as per RCW 42.56.120(2)(b)(iv):

Charges for copying - The agency shall take reasonable steps to provide the records in the most efficient manner available to the agency in its normal operations.

Your agency fee demand of $8950.00 for (5) digital files that can fit on a .50 cent CD-ROM disc or a $1..99 USB thumb drive is not supported by the public records act. Your agency is not permitted to charge fees for the staff time necessary to prepare the records for inspection. Your agency is also not permitted to distinguish among requestors. Your agency has a long history of providing exactly the responsive public records I have requested in exactly the format I have requested to other public records requestors. FEES FOR REDACTION - UNLAWFUL

RCW 42.56. 120 (2)(e). An agency cannot charge a "redaction fee" for the staff time necessary to prepare the records for inspection, for the copying required to redact records before they are inspected, or an archive fee for getting the records from off-site.

LARGE REQUESTS CANNOT BE PROHIBITED

(3) "Overbroad" requests. An agency cannot "deny a request for identifiable public records based solely on the basis that the request is overbroad." RCW 42.56. 080. However, if such a request is not for identifiable records or otherwise is not proper, the request can still be denied.

RCW 42.56.080(2) Agencies shall not deny a request for identifiable public records solely on the basis that the request is overbroad.

CONSTRUCTIVE DENIAL IS PROHIBITED UNDER THE ACT

(2) Upon the motion of any person who believes that an agency has not made a reasonable estimate of the time that the agency requires to respond to a public record request or a reasonable estimate of the charges to produce copies of public records, the superior court in the county in which a record is maintained may require the responsible agency to show that the estimate it provided is reasonable. The burden of proof shall be on the agency to show that the estimate it provided is reasonable.

This request is for identified public records and writings to be exported from NORTHSHORE SCHOOL DISTRICT email data servers in accordance with the public records act as requested public data from a specific public database.

You requested to receive the responsive records via email attachment, or via no password, no registration internet cloud-based download link.

On January 2, 2024, we notified you that our search identified approximately 619,570 responsive electronic records; that we would be charging a copying cost of five cents per each four electronic files or attachments; that we would be charging a ten percent deposit; and that we would close the request if you did not pay the required deposit by January 31, consistent with Procedure 4040P, RCW 42.56.120, and WAC 44-14-040(12).

On January 5, 2024, we requested clarification about the time frame for your request. We initially misinterpreted your response to our request for clarification, and our subsequent correspondence has thus used a time frame of 1-11-2015 to 11-17-2023 rather than your actual requested time frame of 1-11-2015 to 2-1-2023. This resulted in us stating that there were approximately 716,000 responsive electronic files, rather than 619,570 responsive electronic files.

As a result, on January 19, 2024, we adjusted the applicable copying costs and required deposit; provided additional information underlying the applicability of those costs; and reiterated that we would close the request if you did not pay the required deposit.

We reiterated that information again on January 25, 2024.

It is now February 2, 2024, and you have not submitted any deposit based on our respective estimates of 619,570 responsive electronic files or 716,000 responsive electronic files. As a result, the District is entitled to close your request consistent with Procedure 4040P, RCW 42.56.120, and WAC 44-14-040(12).

However, as a sign of good faith, and given our misreading of your response to our request for clarification, we will provide you with an additional 30 days in which to pay the required deposit before we close the request for non-payment. To clarify, we are now proceeding based on our understanding that your requested time frame is 1-11-2015 to 2-1-2023. There are approximately 619,570 responsive electronic files, for a total estimated copying charge of $7,744.62. The 10% deposit due by March 1, 2024, is thus $774.46. If we do not receive that deposit by March 1, we will close your request.

We reiterated that information again on January 25, 2024.

On February 2, 2024, as a sign of good faith, we allowed you additional time to submit your deposit until March 1, 2024.

It is now March 5, 2024, and you have not submitted the required deposit authorized by RCW 42.56.120(4). As a result, consistent with Procedure 4040P, RCW 42.56.120, and WAC 44-14-040(12), we are closing N000681.
