We wish to notify you that we have already begun the process of locating the records as described in your letter, and intend to comply with the requirements of the Public Records Act in allowing you the opportunity to review and have all such documents which are subject to disclosure. Please note that due to a significant criminal cyber attack in September 2019, the District is unable to access a significant portion of District emails from 2009 through October 2019. As a result, in response to your request, the District will be unable to provide any emails that were made inaccessible by the cyber attack.
We need to determine what records are in the District’s possession responsive to your request. We anticipate being able to respond by Thursday, February 27, 2020. If there is any delay in researching or producing the records, I will let you know.

Derek, We have checked with Technology and here is their response to your question: While we are using O365 for email, we are not using it for email archive services because we just moved there December 2018 and already had a mail archiver with over 60 million messages in it at that time. The cyber attack unfortunately destroyed several data stores on the mail archive server which means that we have several entire past years prior to December 2018 for which we cannot retrieve messages. All of those are from before our move to O365 so Microsoft's eDiscovery tools will not be useful in recovering them. Please let me know if you have any questions. Doug Hale 425-408-7605

We received the above clarification from you, and it raises the following questions:
Do you mean October 4th or August 4th? Your original request was for October 4th. Do you want emails for just single dates of September 18th and August (October?) 4th, or for the date range of September 18 through August or October 4?
We received the clarification from you with regard to the emails from Jon Biggerstaff, and we received the same message twice. Did you mean to apply your clarification to the request involving Allen Miedema as well?
