From: Jonathan Fertig

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

All correspondence relating to the purchase (or repurposing) of equipment required for, and planning of, the maintenance of separated bicycle facilities during and after snow fall. We also request correspondence related to policies regarding the storage of snow in unprotected bike lanes.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Jonathan Fertig

Jonathan,

The Law Department is in receipt of your request for "all correspondence
relating to the purchase (or repurposing) of equipment required for, and
planning of, the maintenance of separated bicycle facilities during and
after snow fall. We also request correspondence related to policies
regarding the storage of snow in unprotected bike lanes."

The City has initially determined that appropriate custodians might be Stefanie
Seskin, Najah Casimir, Najah Shakir, Gina Fiandaca, Chris Osgood, Michael
Dennehy, and Michael Brohel, and that appropriate search terms within those
custodians' documents might be Bike Lane Snow Plowing, Bike Lane Snow
Removal, Separated Bike Facility Snow Plowing, Separated Bike Facility Snow
Removal.

Can you please review this list of custodians and search terms and
determine whether you want to add to these options or remove any of these
options? We would also request that you provide us with a date range that
you want searched.

Once we know the number of documents that are identified as a result of
your search terms, we will be able to provide you with a fee estimate for
our review and redaction of your request.

Thanks,

David J. Zuares, Esq.

Dear Mr Zuares-
I would like to restrict the time during which correspondence concerning this matter was mentioned to the year 2017.
In addition to the names that you referenced, I would also like to add Vineet Gupta and Charlotte Fleetwood to the list of custodians.
The search terms should include "Mass Ave" and/or "Massachusetts Ave", as that is the specific street about which I am concerned.

I look forward to hearing from you soon.

From: David Zuares

Mr. Fertig,

The City ran the following search of its electronic database and found zero
results:

Dates: 1/1/17 - present
Custodians: Vineet Gupta, Charlotte Fleetwood, Stefanie Seskin, Najah
Casimir, Najah Shakir, Gina Fiandaca, Chris Osgood, Michael Dennehy, and
Michael Brohel
Terms: "Bike Lane Snow Plowing" OR "Bike Lane Snow Removal" OR "Separated
Bike Facility Snow Plowing" OR "Separated Bike Facility Snow Removal"

The City also ran the same search with "Mass Ave" and "Massachusetts Ave"
as additional terms and found zero results.

The City also ran the search with "Mass Ave" and "Massachusetts Ave" as
independent terms for the same search custodians, and got 1,606 results.
It seems likely that most of these documents will not be responsive to your
original request.

I talked to a few City employees and they suggested another way to respond
to your request -- rather than a larger electronic search for custodians,
search terms, and dates, they could try to their best ability to
individually locate relevant documents they can find and we can produce
them to you within a reasonable time. Does that option work for you?

Thank you,
