Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

Records of payments made from the Office of the Comptroller's account for settlements and judgments, related to separation, severance, transition, or the settlement of any legal claim(s), to vendors, contractors, or employees of the Commonwealth of Massachusetts Information Technology Division, a.k.a Massachusetts Office of Information Technology, a.k.a. The Executive Office of Technology Services and Security since January 1, 2014. For the avoidance of doubt, I am requesting that the Comptroller's response include but not be limited to the payee's name and amount paid, and redacted, where applicable, as described by the "Globe" decision (http://www.sec.state.ma.us/pre/pretraining/trainingpdf/Globe-v-AF-June-14-2013.pdf).

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Also, to clarify my request, please provide a copy of the settlement agreement or judgment, and copies of records of the related settlement reports, which typically indicate :
a. the principal amount of the settlement or judgment;
b. the amount of any attorney's fee award;
c. the amount of any interest award or accrued, and whether the interest to accrue post-judgment;
d. a request for payment of the amount;
e. a description of the basis for the request, (e.g., court order or settlement
agreement); and
f. whether the assigned attorney desires to award the payment check to the Claimant. 815 CMR 5.09(l)(a).

The payments related to ITD/MassIT/EOTSS would be listed under the department code ITD. We also have a webpage dedicated to Settlements and Judgments (https://www.macomptroller.org/settlements-and-judgments), which contains the policies, forms, and other guidance for State Departments. Pursuant to the Settlement and Judgment Policy (attached) Departments are responsible for maintaining all documents related to a claim.
