To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

For any project regarding painting or repainting the Smoots on the Mass Ave Bridge from 1998 to 2018.

- Cost and budget materials for the painting project, such as the project budget

- Any and all contract materials related to contracts set up to paint or repaint the Smoots

-Any and all communications with the Lamda Zeta fraternity to paint the Smoots

-Any and all documents or photographs relating to police details of public works projects to repaint the Smoots

- Any and all communications relating to repainting the Smoots

- Incident reports of vandalism to the rainbow walkways and/or roadways

I would like records to be made available on a rolling basis and I am willing to negotiate on the time frame or the request in general. I can be reached at 617-299-1832.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Boston Police Department (Department) received your request for public
records. This letter shall act as the response to your request for public
records. Please note this response will apply only to the records that
exist and are in the custody of the Department. See A Guide to the
Massachusetts Public Records Law, p. 32, n.115. It is expected that a
custodian of records must user her superior knowledge of her records with
respect to responses to public records requests. See 950 C.M.R. 32.04(5).

Specifically, you requested:

· For any project regarding painting or repainting the Smoots on
the Mass Ave Bridge from 1998 to 2018.

Please be advised that the Mass Ave Bridge is maintained by MassDOT.
Boston Police would not be involved in any bridge maintenance or painting.
Therefore, we would not have any records response to your request. If you
have been denied records by the Boston Police Department, you have the
right to appeal this decision with the Supervisor of Public Records at the
Public Records Division of the Secretary of the Commonwealth.
