Pursuant to the state Freedom of Information Act, G.L.M. c.66, §10, I hereby request the following records:

Any formal or informal reports commissioned by or delivered to the Mayor's Office regarding the Occupy Boston movement, whether concerning the public safety, sanitation or other factors. Mayor Menino has repeatedly stated that the city is "monitoring" the movement for safety concerns. This request is for the written reports of that monitoring.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Thanks for your help. This is my request, originally submitted to mayor@cityofboston.gov as outlined below. I also submitted a similar request to the Boston Police Department, which said that the Mayor's Office would have the responsive documents.

Dear Mr. Morisy,

A search has determined that there are no documents that pertain to “any formal or informal reports commissioned by or delivered to the Mayor's Office regarding the Occupy Boston movement, whether concerning the public safety, sanitation or other factors” in the possession of the mayor’s office.

For your information, briefings conducted by the Boston Police Department/Police Commissioner Edward F. Davis to the Mayor’s Office regarding this issue were done in person, as is standard procedure.

If you are seeking specific sanitation reports or inspectional reports, I would refer you to the Inspectional Services Department. The mayor’s office is not the custodian of public records for that department.
