Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

Please provide any electronic or physical documents exchanged between Landwise Advisors (including but not limited to Jon Trementozzi and/or Jonathan Trementozzi) and the Boston Planning and Development Agency and/or Boston Redevelopment Authority between 7/1/2018 and 11/5/2021 connected to work to analyze the Inclusionary Development Policy. This includes but is not limited to attachments in emails and documents/folders shared through a service like Google Workspace, Google Drive, Dropbox, etc. This includes both documents that Landwise Advisors provided to the BPDA/BRA, and documents that the BPDA/BRA provided to Landwise Advisors.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Good evening,

The Boston Planning & Development Authority (BPDA), received your request
for public records. This email shall act as the response to your request
for public records.

It is expected that all records responsive to this request will be provided
within twenty-five business days from the date we received your written
request. G. L. c. 66, § 10(b)(vi); 950 CMR 32.06(2)(i) (reasonable time
frame shall not exceed 25 business days), so long as an explanation is
provided. The BPDA is currently searching for responsive documents, but
will require the extended time frame due to the extensiveness of the
request. Please note this response will apply only to records that exist
and are in the custody of the BPDA. See A Guide to the Massachusetts
Public Records Law, p. 32, n.115.

Specifically, you requested:

Please provide any electronic or physical documents exchanged between

Boston Redevelopment Authority between 7/1/2018 and 11/5/2021 connected to

Pursuant to the Massachusetts law a municipal records custodian is
permitted to assess fees for the provision of public records. G. L. c. 66,
§ 10 (d); 950 CMR 32.07. A municipality may assess an hourly rate of up to
$25.00 per hour to search for records responsive to public records
requests, but may not charge for the first two hours of work. Black and
white paper copies of records shall be provided at a cost of $.05 per
page. It is presumed that a requester prefers electronic copies of records
when available. There is no per page cost for electronic records. If
necessary voluminous electronic records will be made available on a storage
device. The cost of the storage device will be no more than the actual
cost.

If a fee estimate is necessary I will be in touch shortly with you.

Under Massachusetts law you may appeal this response to the Supervisor of
Records in the Office of the Secretary of the Commonwealth. G. L. c. 66, §
10A; 950 CMR 32.08.

Hello. On January 3 you indicated you should be able to release records later last week. Will they be released this week?

As a reminder, this request was not limited to emails but any electronic or physical documents exchanged between Landwise Advisors and the BPDA/BPRA between 7/1/2018 and 11/5/2021 connected to work to analyze the Inclusionary Development Policy. If there are portions of a document that you believe are exempt, I ask that you still provide the portions that are not exempt along with an explanation of why any documents/portions of documents are exempt.
