From: David Weimer

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

Any and all emails sent or received between 1 January 2022 and 21 April 2022 by DCAMM employees and anyone with an email address containing "@ripplesgroup.com"

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

David Weimer

Response to: Public Records No. 22-84

Dear Mr. Weimer:

The Division of Capital Asset Management and Maintenance (“DCAMM”) received your public records request received on April 26, 2022.

You requested:

“Any and all emails sent or received between 1 January 2022 and 21 April 2022 by DCAMM employees and anyone with an email address containing "@ripplesgroup.com<mailto:“Any%20and%20all%20emails%20sent%20or%20received%20between%201%20January%202022%20and%2021%20April%202022%20by%20DCAMM%20employees%20and%20anyone%20with%20an%20email%20address%20containing%20%22@ripplesgroup.com>”

Your request is quite broad with respect to the email addresses requiring review and therefore will be considerably time consuming and may require assessment of a fee. DCAMM has several hundred employees, a significant number of which we believe would have no connection with the sought after correspondence. Is there a more focused list of DCAMM employees you might provide which would narrow the scope of this search? This would allow for a more meaningful search, reduce turnaround time and may obviate the need for an assessment.

If desired, please submit a new request clarifying in detail the DCAMM employees about which you seek record(s) using our form located here: https://www.mass.gov/forms/dcamm-public-records-request-form
or you may contact us at publicrecords.dcamm@mass.gov<mailto:publicrecords.dcamm@mass.gov>. We’d be happy to work with you in tailoring your request to help ensure you receive the non-exempt records you seek.

Please advise us if you elect to proceed with the request as originally constituted.

Further, for purposes of managing the several hundred requests we receive annually, it is preferred that individuals utilize our web request form found at https://www.mass.gov/forms/dcamm-public-records-request-form. By using this site, it aids in our tracking and response times, and we ask you consider its use for future requests.

If you wish to challenge any aspect of DCAMM’s response, in accordance with G.L. c. 66, § 10 and 950 CMR 32.00, you may appeal to the following office: Supervisor of Public Records, Office of the Secretary of the Commonwealth, Public Records Division, One Ashburton Place, 17th Floor, Boston, MA 02108, and in accordance with G.L. c. 66, § 10A(c), you have the right to seek judicial review of an unfavorable decision by commencing a civil action in the Superior Court.

Sincerely,

PUBLIC RECORDS UNIT
