Public Records Request Extension Date: March 30, 2021
Dear Mr. Kifle:
Thank you for your correspondence this morning. We are actively working on your Public Record Request No. 21-39, but require a further extension of time for providing you with a response. We believe that certain of these documents may be able to be provided sooner and, in order to be most responsive to you, we think it would be beneficial to have a discussion to clarify and prioritize your request(s). We have been unable to locate a telephone number for you, and ask that you please contact us to schedule a call so we can discuss your request and perhaps accelerate the collection and review process.
Please note that by agreeing to this extension you are not waiving any of your statutory rights under the Massachusetts General Laws Chapter 66, as amended by Chapter 121 of the Acts of 2016 (the “Public Records Law”). Please also note that some or all of the documents you requested may not be in the possession, care and/or control of DCAMM and/or may be subject to an exemption from disclosure under the Public Records Law.
We appreciate your continued understanding. If you have any questions or concerns, please don’t hesitate to contact us at (617) 727-4050 or publicrecords.dcamm@mass.gov<mailto:publicrecords.dcamm@mass.gov>.

Hello,

Thanks for your email. I believe Chris Guerin spoke with Rachel Roth. She and I have similar goals. It sounds like you are able to segregate and hold what appear to be routine administrative emails for now that we may review later. But for now you can prioritize emails relating to planning, discussion, analysis, and the like about women's incarceration, conditions, physical buildings, etc.

Would a similar arrangement work and allow you to process this request on a faster timeline?

with thanks,

From: Division Of Capital Asset Management And Maintenance

Mr. Kifle:

Thanks for reaching out. We have been trying to devise ways to identify responsive records more efficiently and we think the proposal below may accomplish this. While we can’t assure a faster timeline, logic suggests the fewer types of records we review, the quicker the process. A similar approach to your requests should help speed all responses. Please let us know if you’re amenable to applying this approach to all MuckRock-related requests.

Respectfully,

PUBLIC RECORDS UNIT

Response to: Public Records No. 21-39

Dear Mr. Kifle:

The Division of Capital Asset Management and Maintenance ("DCAMM") received your public records request dated February 16, 2021.

You requested:

"All email communication to and from your department occurring between January 1, 2020 and March 31, 2020 regarding,
'Mass. State Project DOC 2002'
'Strategic Plan for Incarcerated Women in Massachusetts'
'Baystate Property',
'Baystate Correctional Center',
'Women's Prison',
'Trauma Informed Prison'
'Bay State Correctional Center - Women's Facility'
'Strategic Plan and Feasibility Study for Women's Corrections in the Commonwealth'
'Facility conditions at MCI Framingham.'"
We are providing documents responsive to your request via our Interchange File Transfer Service. You will receive a separate email to view those files.

Please note, a portion of the attached material was determined to be exempt pursuant to Massachusetts General Laws Chapter 4, Section 7(26)(n) which reads as follows:

Exemption (n) applies to: records, including, but not limited to, blueprints, plans, policies, procedures and schematic drawings, which relate to internal layout and structural elements, security measures, emergency preparedness, threat or vulnerability assessments, or any other records relating to the security or safety of persons or buildings, structures, facilities, utilities, transportation, cyber security or other infrastructure located within the commonwealth, the disclosure of which, in the reasonable judgment of the record custodian, subject to review by the supervisor of public records under subsection (c) of section 10 of chapter 66, is likely to jeopardize public safety or cyber security.

The redacted portion of the records include floor plans, internal layout and structural elements relating to the safety and security of persons and critical infrastructure as well as information on computer network resources, the very records which are the focus of the exemption. See People for the Ethical Treatment of Animals, Inc. v. Department of Agricultural Resources, 477 Mass. 280 (2017) at 289 (requiring a determination whether and to what degree the record sought resembles the records listed as examples in the statute).

The subject of your request relates to women's correctional facilities in Massachusetts. Knowledge of floor plans, layout, structural elements, and security measures and policies, exposes the public, inmates and these valuable Commonwealth assets to threat actors and jeopardizes physical security. Likewise, knowledge of network paths and related technical resources exposes these valuable Commonwealth assets to threat actors and jeopardizes cyber security. It is therefore the determination of this office that disclosure of the redacted portions of the subject record is likely to jeopardize public and cyber safety and security.

Further, we are withholding certain correspondence pursuant to the Deliberative Process Exemption set out at G.L. c. 4, § 7(26)(d) ("Exemption (d)"). The subject correspondence, on which policy position development is or may be based, is ongoing and therefore exempt from mandatory disclosure. Exemption (d) is intended to avoid release of materials that could taint the deliberative process if prematurely disclosed.

If you wish to challenge any aspect of DCAMM's response, in accordance with G.L. c. 66, § 10 and 950 CMR 32.00, you may appeal to the following office: Supervisor of Public Records, Office of the Secretary of the Commonwealth, Public Records Division, One Ashburton Place, 17th Floor, Boston, MA 02108, and in accordance with G.L. c. 66, § 10A(c), you have the right to seek judicial review of an unfavorable decision by commencing a civil action in the Superior Court.

Sincerely,

PUBLIC RECORDS UNIT
