Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

I request all email communication between and among the DOC, DCAMM, EOPSS, and the Governor’s Office from November 1, 2020 to December 31, 2020 regarding “women’s incarceration” and/or “women’s corrections.”

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Response to: Public Records No. 21-62

Dear Deeper than Water:

The Division of Capital Asset Management and Maintenance (“DCAMM”) received your public records request dated March 2, 2021.

You requested:

“email communication between and among the DOC, DCAMM, EOPSS, and the Governor’s Office from November 1, 2020 to December 31, 2020 regarding “women’s incarceration” and/or “women’s corrections.”

We are providing documents responsive to your request via our Interchange File Transfer Service. You will receive a separate email to view those files.

Please note, portions of the requested records have been withheld or redacted pursuant to the Deliberative Process Exemption set out at G.L. c. 4, § 7(26)(d) (“Exemption (d)”). This exemption applies to inter-agency or intra-agency memoranda or letters relating to policy positions being developed by the agency, in this instance, policy relating to corrections in the Commonwealth. Policy positions being developed by the agency is ongoing and therefore exempt from mandatory disclosure at this time.

In addition, we have redacted other elements of the requested records pursuant to G.L. c. 4, § 7(26)(n) which applies to:

Records including, but not limited to, blueprints, plans, polices, procedures and schematic drawings, which relate to internal layout and structural elements, security measures, emergency preparedness, threat or vulnerability assessments, or any other records relating to the security or safety of persons or buildings, structures, facilities, utilities, transportation, cyber security or other infrastructure located within the commonwealth, the disclosure of which, in the reasonable judgment of the custodian, subject to review by the supervisors of public records under subsection (b) of section 10 of chapter 66, is likely to jeopardize public safety or cyber security.

In the instant matter, we redacted or withheld certain items displaying internal layout, structural elements and security measures at Commonwealth corrections facilities, the disclosure of which, in the reasonable judgment of this office, is likely to jeopardize public safety or cyber security.

In addition to the redacted material noted above, we have redacted certain other interoffice correspondence which we have determined is protected by the attorney-client privilege, the applicability of which was upheld in Suffolk Construction Co., Inc., v. Division of Capital Asset Management, 449 Mass. 444 (2007). The subject internal correspondence is between DCAMM business units and DCAMM’s Office of General Counsel made for the purpose of obtaining legal advice or assistance, has not been disclosed to third parties, and the privilege of which has not been waived. A log of this correspondence is attached.

Further, with respect to your request, please note that certain information has been redacted as it applies to records that contain the personal email address of an employee while identifying the individual as a government employee. M.G.L. c. 4, §7(26)(o) sets forth this exemption, which applies to:

the home address, personal email address and home telephone number
of an employee of the judicial branch, an unelected employee of the
general court, an agency, executive office, department, board,
commission, bureau, division or authority of the commonwealth, or of
a political subdivision thereof or of an authority established by the
general court to serve a public purpose, in the custody of a
government agency which maintains records identifying persons as
falling within those categories; provided that the information may be
disclosed to an employee organization under chapter 150E, a
nonprofit organization for retired public employees under chapter
180, or a criminal justice agency as defined in section 167 of chapter
6.100

Accordingly, we redacted the personal email address of an unelected State employee identified as a government employee in these records.

If you wish to challenge any aspect of DCAMM’s response, in accordance with G.L. c. 66, § 10 and 950 CMR 32.00, you may appeal to the following office: Supervisor of Public Records, Office of the Secretary of the Commonwealth, Public Records Division, One Ashburton Place, 17th Floor, Boston, MA 02108, and in accordance with G.L. c. 66, § 10A(c), you have the right to seek judicial review of an unfavorable decision by commencing a civil action in the Superior Court.
