Ed Davis drone emails

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

All emails sent to or received by Boston Police Commissioner Ed Davis between Sunday, April 14 and the date this request is processed that contain the following keywords:

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I have received your fee estimate for my request for Commissioner Davis' emails regarding drones, UAVs, etc.

I respectfully request a second estimate, for three reasons:

First, BPD did not acknowledge my request in any way for more than three months after it was submitted. Under MGL, all requests must receive some sort of reply within 10 business days.

Second, the search time seems excessive to conduct a simple email keyword search. Note that there will be little to no segregation time required, as I have requested all emails containing the keywords, rather than emails pertaining to a particular topic.

Third, the MGL requires that records requests be processed by the lowest-paid staff member qualified to complete the request. I am skeptical that the lowest-paid member of your staff qualified to conduct the initial search is paid at an hourly rate of $47.59/hr, while the staffer qualified to review the documents for release is paid an hourly rate of $35.40/hr.

Please advise of an updated fee estimate.
