To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

I'm looking for the Boston Police Department report on the fatal car crash that took place on June 12, 2015 in the North End; attempting to learn identity of the driver, who was killed.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Bob Brown

Mr. Brown,

We have just received your FOIA request - just wanted to inform you that
while the police report is certainly a public record in possession of the
police department, the name of the victim will be redacted from it prior to
release. Let us know if you still wish to go forward with your request
knowing that piece of information will not be included.

Thank you,

Officer Stephen McNulty

Officer McNulty

Thank you for the reply. Yes, I'd like to receive the report still if that's possible, though no hurry. Is there a reason victims' names arent released for car accidents but are for other fatalities, such as homicides? I see that other agencies, such as the state police, do release car accident victims' identities. I'd like to at least be able to explain that to our readers.

Regards, Bob Brown

Sir,

As mentioned in previous responses, police reports may be obtained at
Boston Police Headquarters located at One Schroeder Plaza, Boston, MA
02120. The hours of operation are Monday-Friday 8:30AM-4PM with extended
hours until 6PM on Tuesdays. For your convenience, a copy of the report you
have recently requested has been attached to this email.

As a general practice of the Boston Police Department, the identities of
victims are withheld out of respect for the victims' privacy/safety and
their families' privacy/safety. The BPD often releases the names of victims
of homicides or special cases for investigative purposes; however, the
incident to which you are referring is not a homicide, therefore, the
department will not be releasing the victims' identities.

Please consider this request closed.

Respectfully,
BPD Office of Media Relations
