Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:
All emails from BPD Commissioner Ed Davis from October 1, 2013 to the day this request is processed that contain the following keywords:
-Crime and Justice Institute
-Harvard
-Scott Harshbarger
-Paul Swindlehurst
-Institute of Politics
I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Could you give me more details on the responsive documents, namely how many pages of responsive documents you've reviewed? Three hours of review time for emails seems excessive.

That invoice for search, segregation and review time as well as the four
pages of emails came from our legal department. Please let me know if you
wish to continue with the request.

Mr. Estrada:
As I'm sure you know, the Massachusetts Public Records Law requires that the lowest-paid employee who is competent to perform a search or review is the one who must conduct each step of fulfilling the request. Please confirm (with careful consultation with the legal unit) that the lowest paid BPD employee who could have conducted this search is paid at an hourly rate of $47.59. Furthermore, please confirm with the employees who conducted the search and review that it took 2 hours of search and 1 hour of review to locate 4 total pages of emails.
Again, these numbers strike me as excessive billing rather than efficient processing.
