Cars Towed in Boston

Dear Boston Transportation Department,

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

An electronic record showing details of cars towed in the city of Boston between January 26 and the date on which you retrieve/export the records, including any and all non-exempt fields, including but not limited to date towed, reason towed, location where the car was parked when it was towed, license plate number, tow company and tow lot. I understand Boston Transportation Department maintains this information in a database, and I ask that you please provide these records in their original, electronic format, such as a spreadsheet or delimited text file. Please contact me with any questions regarding the format.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of my work as a reporter for major media outlets, and processed by me, a representative of the news media/press. I make this request in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for time and commitment to an open and transparent government process. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

It has been two months now since I filed this request, and the department has not only failed to respond within 10 days, as the law requires, but it hasn't even acknowledged its existence.

Is the Department of Transportation simply ignoring this request for public records?

If the department is planning to respond as required by the law, please immediately provide the contact information for the person who will be handling my request.
