Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

All Boston Police Department Journal Book (AKA Blue Book, Detail Book) entries related to December 4, 2014

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Mr. Lipton,

You have requested documents in the possession, custody or control of the
Boston Police Department under the Massachusetts Public Records Request Act
(M.G.L. c. 66, § 10). Specifically, you have requested all Boston Police
Journal Book (AKA Blue Book, Detail Book) entries related to December 4,
2014.

The information you have requested is exempt from disclosure pursuant to
M.G.L. c. 4 § 7(26)(n). M.G.L. c. 4 § 7(26)(n) allows for the withholding
of certain records which if released would jeopardize public safety. It is
the duty of the custodian of records to exercise reasonable judgment to
determine whether release of the record is likely to jeopardize public
safety.

Some examples of information that may jeopardize public safety may be a
list or record showing where law enforcement personnel may be staged and
how many officers may respond to a given situation. The information you
have requested would show where law enforcement personnel are staged, how
many officers may respond to a given situation, how many officers are
assigned to a particular shift, how many officers are assigned to a
particular station on a particular shift, etc. This information, if
released may jeopardize the public by giving an unfair advantage to someone
with nefarious intentions, who could prevent law enforcement officers from
properly responding to emergency situations.

As an alternative, I have attached the most recent strength report for the
BPD which provides overall personnel numbers citywide.

For these reasons, the Department is denying your request for all Boston
Police Journal Book (AKA Blue Book, Detail Book) entries related to
December 4, 2014 pursuant to M.G.L. c. 4 § 7(26)(n).

Please be advised that this office does not provide legal assistance,
opinions or explanations about police policy to the public, and will not
respond to any such request. If you have been denied records by the Boston
Police Department, you have the right to appeal this decision with the
Supervisor of Public Records at the Public Records Division of the
Secretary of the Commonwealth.
