Pursuant to Open Public Records Act ("OPRA"), I hereby request the following records:

Please provide me with all records of the police response to the shooting committed by Rasheed Cherry at the Bloomfield carnival grounds on 5/7/2010. The records I am requesting include but are not limited to incident reports and discharged round reports.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Dear Requestor:

The Township of Bloomfield received your Open Public Records Act (OPRA) Request on August 8, 2016. As such, the seven (7) business day deadline to respond to your request was August 17, 2016; however, the Township requires additional time to respond to your request. This notice of extended due date is being provided to you on the 2nd business day after the Township's receipt of said request.

Your OPRA request sought access to the following:

"....Please provide me with all records of the police response to the shooting committed by Rasheed Cherry at the Bloomfield carnival grounds on 5/7/2010. The records I am requesting include but are not limited to incident reports and discharged round reports...."

Your request requires additional time beyond the seven (7) business days to fulfill because the records requested are stored in an area accessible to only certain Police Department personnel who are currently on vacation. Once access to the records is obtained they will need to be reviewed to determine if they can be released. OPRA allows custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5.i. Specifically, OPRA states that, "the requestor shall be advised by the custodian when the records can be made available. If the record is not made available by that time, access shall be deemed denied."

Your request requires an extension of time until August 24, 2016.

If your request for access to a government record has been denied or unfulfilled within the seven (7) business days required by law, you have a right to challenge the decision by the Township of Bloomfield to deny access. At your option, you may either institute a proceeding in the Superior Court of New Jersey, or file a complaint with the Government Records Council (GRC) by completing the Denial of Access Complaint Form.
