Pursuant to Open Public Records Act ("OPRA"), I hereby request the following records:

All police records and/or incident reports generated by the Bergen County Police Department, including the Bomb Squad, pertaining to any incidents that took place at the following address on January 23 2013:

218 TRUMAN DR, CRESSKILL, NJ 07626

Records requested include all recordings, if available, of radio or telephone communications between the Cresskill Police Department and Bergen County Police Department, including its Bomb Squad, pertaining to any incidents that took place at the above address on January 23 2013.

Given the sensitive nature of the requested documents, I am willing to accept any immediately releasable records that do not require redaction or review due to classified and/or proprietary policies involving the identification and disposal of bombs by the Bergen County Bomb Squad.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Please be advised that I am in receipt of your OPRA request seeking various records. I have attached a copy of the incident report as requested. However, I was unable to obtain copies of any audio recordings as those recordings are only retained for 90 days and the 90 day time period has elapsed. In addition, your request for E-mail correspondence is overly broad and cannot be ascertained without a specific incoming e-mail address. Mag Entertainment, LLC v. Div. of Alcoholic Beverage Control, 375 N.J.Super. 30, 37 (App. Div. 2005).
