PRR 02032020-Anon
Dear Requestor:
On behalf of the Bellevue School District, I am acknowledging receipt of your request for public records under the Public Records Act, Chapter 42.56 RCW. Please note that initial responses are due within 5 business days of receipt, RCW 42.56.520, which in the case of your request would be 2.10.2020 (received 2.03.2020).
I understand your request to be:

1. I request an electronic copy of all email communications between any employee of the Bellevue School District and any member of the Washington School Personnel Association for the years 2014-2020.

2. I request an electronic copy of all emails in the possession of the Bellevue School District to or from any user of the internet domain WSPA.NET for the years 2016-2020.

3. I request an electronic copy of all RECORDS and WRITING, documents, agreements, meetings, papers, scheduling, etc. referencing the Washington School Personnel Association for the years 2014-2020.

Clarification Question re item 1:
A requestor must request an "identifiable record" or "class of records" before an agency must respond to it. RCW 42.56.080<http://app.leg.wa.gov/RCW/default.aspx?cite=42.56.080> and 42.56.550<http://app.leg.wa.gov/RCW/default.aspx?cite=42.56.550>(1).
An "identifiable record" is one that is existing at the time of the request and which agency staff can reasonably locate. WAC 44-14-04002.
Regarding your item 1, the Bellevue School District is not a custodian of the current or any prior membership list of the Washington Personnel Association, or does the District have the email addresses of such members. Therefore, the District is unable to conduct a search that would identify records of email communications between any District employee and any member of the WSPA between 2014-2020. Thus, the District will not be able to respond to this request unless you provide more specificity. Your response to this clarification is required within 30 days (on or before March 9, 2020) or the District will consider this item completed as withdrawn.

Clarification Question re item 2:
An initial search has been conducted that identified over 600 potentially responsive messages. Please advise, in view of the volume of potentially responsive messages, whether you want to limit the time frame of your request or identify a topic of interest.

Clarification Question re items 1, 3:
The date range stated in your email subject line is 2016-2020. Items 1 and 3 date ranges of 2014-2020. Please clarify the date range of your request.

Your request may be completed in installments. I estimate a first installment can be made on or before April 13, 2020.
Please advise if you have any questions or concerns.
Best regards,

Dear Ms. Boyer,

Thank you for your email.

In response to your request for clarity:

Clarification:

A partial list of individuals identified as representing the Washington School Personnel Association (past or present):

Kurt Schonberg, Shaun Carey, Debby Carter, Janet Hodson, Lisa turner, Jane Rausch, Kim Harmon, Heather Crail, Toni Neidhold, Marlyn Boerke, Cathi Brinck-Price, Dawn Long, Denise Kenney, Chelle Lente, Connie Sheridan, Jason Thompson, Jennifer Tottenham, Patricia Anderson, Debbie Leighton, Valerie Burkhauser, Betsy Dickenson Jenae Gomes, Kirk Barney, Paula Jefferies, Joan Steiner, Tenille Jeffries-Simmons, Chris Willits, Betsy Meador, Michelle Powers, Shirley Clarkson, Becky Durkin, Cathi Price, Mike Johnson, Chris Burton, Missy Hallead, Beverly Johnson-Torelli, and Curtis Leonard.

Clarification Question re item 2:
An initial search has been conducted that identified over 600 potentially responsive messages. Please advise, in view of the volume of potentially responsive messages, whether you want to limit the time frame of your request or identify a topic of interest.

Clarification:
I would request the responsive messages to be produced in electronic .pdf format. The maximum file size for a .pdf document is currently 10 GB. Average email page estimates are 100,000 pages per GB or < 1,000,000 pages per .pdf file. The volume of electronic email messages produced electronically in a single file should not become overly burdensome until production approaches 1 million pages, at which point I would request remaining message production begin in separate .pdf file(s). No, I do not wish to limit the requested time frame.

The topic of interest is identified as the Washington School Personnel Association.

Clarification Question re items 1, 3:
The date range stated in your email subject line is 2016-2020. Items 1 and 3 date ranges of 2014-2020. Please clarify the date range of your request.

Clarification:
My apologies – the date range is 2014-2020.

Please email if you have any questions.

Thank you

From: Bellevue School District

Dear Requestor:
Please restate your item 1. I do not understand how you intend the names you have listed to be applied to a search. Are you asking for any communication between any of the listed individuals and any employee of the Bellevue School District if that communication is based on a shared membership status in WSPA? For example, it appears that some of these persons may have been on WSPA membership lists or list-serves through which news or updates were provided to WSPA members. Please state whether that is the nature of communications you are seeking.

Also, I note that at least one of the persons on your list, Curtis Leonard, uses an email address that ends in the domain “wspa.net”. Messages to or from users of that domain will be picked up in searches responsive to item 2, but for a different time frame, 2016-20. If you want messages to or from Curtis Leonard or others using the “wspa.net” domain to be retrieved, please reconcile what appear to be inconsistent time frames.

Dear Requestor:
Thank you for the restatement of item 1, which is helpful. I have an additional focused clarification question.
Clarification question:
I understand your restated item 1 is:

Item #1 - Restatement:

I request the District produce email communications between any District employee and any representative of the WSPA between 2014-2020. The following is a list of some identified WSPA representatives during the years 2014-2020:

Please define what you intend by “any representative of the WSPA.” Based on my preliminary research, a few of the persons on your list are or were employees of WSPA. Some of them may have been elected officers or regional officers of the Association and may have served as officers during one or more years. Some of them appear to be members only so are not “representatives” of WSPA.
Thank you.

Hello Ms. Boyer,

In response to your query about what I intend by “any representative of the WSPA" I use the word representative to encompass the following synonyms for the word representative: agent, member, staff, worker, employee, director, trustee, affiliate, associate, contractor, officer…etc. of the Washington School Personnel Association. Any representative would include employees of the WSPA, officers of the WSPA (past or present), directors of the WSPA, members of the WSPA, etc.

It has only recently come to my attention that school district employees could be members of the WSPA and possibly server as an officer or director of the WSPA as well.

Please contact me if you have further questions.

Thank you.

From: Bellevue School District

Thank you. I think we are close to a shared understanding.
Clarification re item 1:
Please allow me to confirm my understanding. Your request is that the Bellevue School District produce “email communications between any District employee and any “representative” of the WSPA.” “Representative” is defined to include “member” and the other synonyms listed in your 2.12.20 2:59 PM message below (agent, staff, worker, employee, director, trustee, affiliate, associate, contractor, officer).

Also, you stated on 02.07.20 that “the topic of interest is identified as the Washington School Personnel Association.”
Thus, I understand your request to be directed toward communications in which the topic is WSPA, WSPA news, or WSPA information. That is, at least one of the persons in the exchange is “representing” WSPA in some capacity in that communication.

Please advise if my understandings are correct.

Good Morning,

Yes I would agree with you on both. This request is only seeking materials regarding the relationship (business or otherwise) between Bellevue School District and it's employees and the Washington School Personnel Association. The communications topics would include WSPA pursuing it's purpose and goals with the District, including contracts, training, lobbying, collective bargaining, meetings, etc.

Thank you.

Dear Requestor:
Thank you for your response. This is helpful so that the District and you share an understanding that will allow the District to assemble records you intend to receive.
In order that we have the shared language in one place, please allow me to state my understanding of your request item 1. This begins with your Feb 8 restatement and adds text from our more recent exchanges:

I request the District produce email communications between any District employee and any representative of the WSPA between 2014-2020. The following is a list of some identified WSPA representatives during the years 2014-2020:

Kurt Schonberg, Shaun Carey, Debby Carter, Janet Hodson, Lisa turner, Jane Rausch, Kim Harmon, Heather Crail, Toni Neidhold, Marlyn Boerke, Cathi Brinck-Price, Dawn Long, Denise Kenney, Chelle Lente, Connie Sheridan, Jason Thompson, Jennifer Tottenham, Patricia Anderson, Debbie Leighton, Valerie Burkhauser, Betsy Dickenson Jenae Gomes, Kirk Barney, Paula Jefferies, Joan Steiner, Tenille Jeffries-Simmons, Chris Willits, Betsy Meador, Michelle Powers, Shirley Clarkson, Becky Durkin, Cathi Price, Mike Johnson, Chris Burton, Missy Hallead, Beverly Johnson-Torelli, and Curtis Leonard.

“Representative” is defined to include agent, member, staff, worker, employee, director, trustee, affiliate, associate, contractor, officer. Any representative would include employees of the WSPA, officers of the WSPA (past or present), directors of the WSPA, members of the WSPA, etc.

The topic of interest is the Washington School Personnel Association. That is, at least one of the persons in the exchange is “representing” WSPA in some capacity in that communication.

This request is only seeking materials regarding the relationship (business or otherwise) between Bellevue School District and its employees and the Washington School Personnel Association. The communications topics would include WSPA pursuing its purpose and goals with the District, including contracts, training, lobbying, collective bargaining, meetings, etc.

Please confirm whether that is an accurate statement of your request.

Dear Ms. Boyer,

From: PRA Washington

Hello,

Please provide an estimate on this 02-01-2020 public records request. Thank you.

From: Bellevue School District

PRR 02032020-Anon
Dear Requestor:
I am responding to your message dated 05.06.2020, attached, in which you request “an estimate on this 02-01-2020 public records request.” Significantly, the attached 05.06.2020 message does not contain all of the prior correspondence related to this request. Specifically, it omits exchanges the District had with you regarding your request dated 02.07.2020 (4 messages), 02.08.2020 (1 message), and 02.12.2020 (1 message). For that reason, I am responding to your message from an earlier point in the correspondence history, after one of the 02.07.2020 messages.

One of the messages omitted from the correspondence history, dated 02.07.2020, addresses your 05.06.2020 inquiry. That 02.07.2020 message is the District’s 5-day response letter (included below), which includes an estimated response date for an initial installment of April 13, 2020. Please note that although you apparently emailed your request on Saturday, February 1, 2020, it is deemed received by the District on the first following business day, February 3, 2020. For several weeks prior to and following the initial estimated installment date of April 13, 2020, the Bellevue School District was closing all District school buildings and offices and transitioning all administrative employees to remote work locations due to the present public health circumstances. As a result, and due to other effects of Covd-19, including added employee responsibilities, a focus on essential operations, and the need to establish work in remote locations, it was not possible to make an installment on that estimated date. Please be assured that the District continues to process public records requests with the fullest service possible during this time.

I will reassemble a complete correspondence history regarding your request and provide it to you in the near future. That history provides critically important information with respect to your request and the District’s response to it. As we go through this process, it is important to leave that history intact and assembled in one place for reference.
Based on clarifications made to your request between 02.07 and 02.13.2020, to which you agreed on 2.13.2020, the District understands your request to be:

2. I request an electronic copy of all emails in the possession of the Bellevue School District to or from any user of the internet domain WSPA.NET for the years 2014-2020.

3. I request an electronic copy of all RECORDS and WRITING, documents, agreements, meetings, papers, scheduling, etc. referencing the Washington School Personnel Association for the years 2014-2020.

This version of your request also reflects your decision to apply the time frame of 2014-2020 to all three items.

On behalf of the Bellevue School District, I am making a first installment today. Please see the attached record, responsive to item 3:
2019_priorities_final_d, 2p

Additional records are being prepared for production to you. I estimate a next installment date of May 11, 2020.

The correspondence you have requested, over a six-year period, affects many employees and former employees. Every affected employee and former employee is entitled under RCW 42.56.540 to notice of your request and an opportunity to review proposed records before they are produced to you. Those notices and review periods will affect the timing of the District’s installments to you, particularly with respect to request items 1 and 2. You may wish to consider a more limited time frame.

Also, please note that COVID-19 has resulted in District closures, redesigning the manner in which the District engages with students and families, and employee work restrictions. Estimated response dates made in your request include consideration of the fact that the staff members who were working on the remaining items of your request are among those who have been focused on making sure the District is appropriately protecting the health of its employees and budgeting accurately during these times. Also, response date estimates made at this time take into account and are subject to adjustment that may arise from these changing circumstances.

Thank you for your interest in Bellevue School District. I hope you and your family are well.
