Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

Memoranda of understanding (MOU's) regarding information sharing between Bellevue Police Department and other entities (e.g., private businesses, trade associations, other police departments, fusion centers, federal agencies, etc.).

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In an attempt to clarify which records I seek, I hereby narrow my request to the following records:

Memoranda of understanding (MOU's) regarding information sharing (the exchange of physical, analog, and digital data both public and non-public, gathered through Bellevue Police Department resources and activities, regardless of transmission method) between Bellevue Police Department and other entities (e.g., private businesses, trade associations, other police departments, fusion centers, federal agencies, etc.) and any agreements, binding or non-binding, to enter into or join groups, networks, or engage services providing information sharing of the same type. Information sharing in this context pertains to discreet information gathered about the public by the resources of the Bellevue Police Department, not to information gathered internally about the Bellevue Police Department for its own organizational, regulatory, or administrative reasons, and not to amalgamated statistical data provided to accredited academic entities for research purposes.

Dear Mr. Aiken:

I am in receipt of your e-mail of April 23, 2013. Thank you for directing me
to an index of every interlocal agreement entered into by the City of Bellevue
since 2008. That will likely be helpful to me in the future. I look forward
to your providing me with access to all of the records I requested.

As you probably know, section 520 of the Public Records Act (RCW 42.56.520)
requires you to do one of the following:

1. Provide the record

2. Provide an internet address and link on the agency's web site to the
specific records requested, except that if the requester notifies the
agency that he or she cannot access the records through the internet, then
the agency must provide copies of the record or allow the requester to view
copies using an agency computer

3. Acknowledge that the agency, the office of the secretary of the senate, or
the office of the chief clerk of the house of representatives has received
the request and provide a reasonable estimate of the time the agency, the
office of the secretary of the senate, or the office of the chief clerk of
the house of representatives will require to respond to the request;

4. Deny the public record request

It is unclear to me whether the two records you provided to me on April 22,
2013, ("LINX Res7083" and "LINX Council Memo") comprise the entirety of
responsive records or not. You have neither provided additional records nor
provided URIs on your Web site for the specific records I requested. Please
clarify.

Dear Mr. Mocek,

In April you requested any MOUs regarding information sharing between the Bellevue Police Department and other entities. I conducted a search of our MOUs and sent the responsive documents to you in April. Today, the person who helped with the search located an MOU in her own computer files. I have attached it. It is from 2009 and we do not have any records showing it was ever activated or completed. We do not have any License Plate Readers or Scanners. This is also signed only the Chief. So, I do not believe this was ever completely processed or employed.

I apologize for our failure to discover the document in the prior search.
