Pursuant to Florida's Sunshine Law (Fla. Stat. secs. 119.01 to 119.15 (1995)), I hereby request the following records:

All contracts (and their amendments) and memorandums of understanding entered into by Bay County, Florida for services and activities related to the Bay Correctional Facility (http://www.dc.state.fl.us/facilities/region1/112.html)

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello Ms. Griffin,

Thank you very much for your message. I am interested in the most recent contracts and MOUs, though I would appreciate all such available documents, if search and provision would not be too time consuming or burdensome. I am primarily interested in materials related to the operation of the facility. I am interested in documents related to its construction and permitting, but I can submit a separate request for that information at a later time, if current submission of that request would result in many hours of search and reproduction and be unnecessarily troublesome at present.

All information you have request can be found on the Bay County Clerk of Court website. http://baycoclerk.com/

Please follow the link above and click on “County Commissioners” under Public Records. Then scroll to the bottom and click View BOCC Records Online. Select “Bay” and click button. This will take you to a menu of all County documents. Under Contracts, sort by Description. The records you are looking for will be listed under Bay County Sheriff (current jail operator) and CCA (previous operator and contractor for the facility). You will avoid copy fees by looking up the documents on our website.

All contracts (and their amendments), memorandums of understanding, intergovernmental service agreements, and any agreements of any sort entered into by Bay County, Florida (or any division thereof) for all services, equipment, and activities involving/provided by/contracted for regarding the Bay Correctional Facility and any facilities associated with it through any of the aforementioned agreements regarding the facility.

Responsive materials should include but not be limited to:

• the initial Invitation to Bid, Request for Proposal, or equivalent call for contractors
• the responsive materials provided by the winning bidder
• all other vendor responses
• all evaluation material, scorecards, reports, and notes generated in the selection process
• the current contract
• all exhibits
• all amendments
• all invoices/receipts detailing compensation received as a result of any agreements
• all agreements related to the provision of services, such as water, sewage, natural gas, garbage, etc.
• all financial agreements (such as loans or bonds) entered into as a result or in association with any of the aforementioned agreements
• all agreements, invoices, and related materials regarding the use of inmate labor by any of this agency's divisions or jurisdictions

Beryl,

It is my understanding from previous emails that you want documents related to construction and operation of the facility, with no specific date range. This documentation is thousands of pages, and will be a very time consuming project. Many of these items will need to be removed from storage.

We estimate the cost per an hour to be $30, with up to 40 hours of time in gathering and producing copies. Partial payment will need to be made before we begin. However, if you wish to come to our office and make copies yourself we would only charge for the staff time associated with gathering documents from storage plus a $.15 charge per page.

In 2008 the Bay County Jail changed operators from CCA to the Bay County Sheriff’s Office.

Please let me know how you wish to proceed.
