This is an acknowledgement of your request below, for public information, submitted to the Document Compliance Unit ("DCU") of the Baltimore Police Department ("BPD"). Your request is governed by the Maryland Public Information Act ("PIA"), Maryland Code, General Provisions Article ("GP"), Sections 4-101 et seq. DCU will process your request promptly. However, our response may take longer than ten (10) working days, the reasons for which may include the scope of your request, the type and volume of potentially responsive records, and the nature of the search, review, and preparation that is required. In any event, DCU will respond to your request within thirty (30) days. GP § 4-203.

DCU will contact you with the availability of records and the possible costs associated with this request, as soon as the information is made available by the Custodian of Records. Likewise, if DCU and/or the Custodian of Records need you to clarify your request, DCU will contact you promptly.

Your request for copies of the current or most recent memorandum of agreement (MOA) or memorandum of understanding (MOU) between your law enforcement agency and any fusion centers is vague and ambiguous. The Baltimore Police Department is only able to comply with requests that the Custodian of Records is able to identify and locate by a process that is not unreasonably burdensome or disruptive of BPD operations. Therefore, the BPD cannot conduct wide-ranging and unreasonably burdensome searches for records. Please be advised the BPD cannot release documents that interfere with enforcement proceedings, could disclosure techniques and procedures for law enforcement investigations or prosecutions that could risk circumvention of the law, or could endanger the life or physical safety of any individual.

If you would like to resubmit your request and identify specific agency or organization, this office will see if the BPD has any records responsive to your request. Please be advise if there are any responsive records, one or more State or Federal statues may the BPD to withhold or redact information.

7 U.S.C. § 2020(e)(8). Certain critical infrastructure information and homeland security information that the federal government shares with the State or local governments may not be disclosed under the PIA. See 6 U.S.C. §§ 133(a)(1)(E) and 482(e), respectively.
