From: Benjamin Lesser
To Whom It May Concern:
Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
A copy of the current list by subject matter, of all records in the possession of the agency.
Per NEW YORK PUBLIC OFFICERS LAW, ARTICLE 6, Section 87(3):
"Each agency shall maintain:
[....]
(c) a reasonably detailed current list by subject matter, of all records in the possession of the agency, whether or not available under this article. Each agency shall update its subject matter list annually, and the date of the most recent update shall be conspicuously indicated on the list."
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.
Sincerely,
Benjamin Lesser

We have received your requests numerous times and I believe Chief Neagle did respond to you. You might want to get ahold of our Corporation Counsel if you wish to contest this.

Hello,
Chief Neagle sent the attached in response to the request for the Auburn Police Department's FOIL rules and regulations in January, but there has been no further communication as to this request for APD's subject matter listing from either the chief or the Corporation Counsel. Please advise, or indicate the appropriate individual/office for followup.
Thank you.
