Pursuant to the Georgia Open Records Act, I hereby request the following records:

Any and all records relating to use of force reports as described under APD.SOP.3010 (linked below). Restrict the time period for all records to June 15, 2019 through December 31, 2019. Records may include, but not limited to:

- Use of Force Reports (Form APD 809)
- All complaints relating to use of force incidents
- All monthly lists of all incidents with a “17F” pull-in as maintained by the Communications Section
- All dash camera footage relating to use of force incidents
- All body camera footage relating to use of force incidents
- Any other video or photographic material relating to use of force incidents
- All electronic communications (such as email) relating to use of force incidents

Good afternoon Zachary,

This is an enormous request. After further review and extensive cost analysis, we have provided the attached estimate. In our experience, the below estimate is on the low side, as there will likely be much more video related to your request. It will take us a better part of two weeks to simply determine the number of hours of video this would include. With that understanding, keep in mind this is only an estimate based on the information we currently have. The total cost and time are subject to change.

We found approximately 505 incidents related to your request.

505 use of force reports will take approximately 16.83 hours to process and redact at $23.31 an hour = $392.31

We won’t know until we’ve spent hours compiling the video, but from our experience, there will be no less than an average of 2 hours of video for each incident. Processing time for video is 3 times the amount of video, meaning this will take 3,030 hours to complete, at $23.31 an hour = $70,629.30.

$70,629.30 + $392.31 = $71,021.61. The first 15 minutes is free which will bring the total down to $71,015.78. Considering the number of hours it will take to complete this, it will likely take 3 years to complete this request.

I tried to give Marla a call about this request yesterday afternoon but must have missed her office hours. Thank you so much for the detailed breakdown of the cost and time for fulfilling the request. That's clearly an untenable workload and would cost far too much; I understand. I'll revise my request downward to exclude video footage and instead limit it to:

- All complaints relating to use of force incidents (already completed)
- Use of Force Reports (Form APD 809)
- All monthly lists of all incidents with a “17F” pull-in as maintained by the Communications Section
- All electronic communications (such as email) relating to use of force incidents

Thanks again for the detailed response, and responsiveness. I know your office is inundated with requests right now, and I appreciate your hard work.

As indicated in the cost analysis we sent to you yesterday, even with you opting out of the video review, there are 505 reports and thousands of pages that will need to be reviewed and redacted (where applicable). This process will take approximately 16.83 hours to process and redact at $23.31 an hour = $392.31 (this is the low end of the cost estimate, it could be more). You are looking at a week or so for completion, and that is barring anything unforeseen happening. Keep in mind, your request is but one of many that we are working on concurrently, and everyone has the same level of urgency and demand. And while we would love to assign a specific staff person to work on just your requests, we just don’t have the staffing or time to do that.
The good news is, the reports you requested from our records department were sent to us yesterday and are in our office. They are in hard copy form. Our records department stated they were unable to send them electronically because of the volume. I’ve attached a picture of the box of records we have for you, so you can understand what we are dealing with. These reports will be provided to you after you agree to the fee (and our lawful redactions are completed).
You will need to arrange to pick these files up, once we finish the process. The remaining items on your list will need to be handled separately. Your request for “All electronic communications (such as email) relating to the use of force incidents” is unattainable. It is overly broad. We can do keyword searches citywide or by an individual. The cost to pull emails is either $95 or $175 depending on the complexity. There could be additional fees depending on the density of the email pulls.
I will assign this project to my staff as soon as we get your approval on costs. Let me know how you want us to proceed.
