Dear Mr. Nash:

This is in further response to your request for records under the provisions of the Virginia Freedom of Information Act and sent via the muckrock.com website on Wednesday, February 19, 2020. The comments below in Red are the responses from Arlington Public Schools (APS) for each of your requests. I have highlighted the two areas that would incur costs.

1. A copy of any data release consent forms parents or students are asked to sign.

APS does not ask parents or students to sign any data release consent forms.

2. Any current policy documents or guidelines governing student data usage

a. SDUPA - This is both a stand-alone agreement and is also included in the standard terms and conditions for all APS vendors. https://www.apsva.us/wp-content/uploads/2019/01/PO-TsCs-Amended-January-2019-Changes-Accepted.pdf

b. The following 8 links are the APS Policies and Policy Implementation Procedures (PIPs) which provide governance over student data usage:

3. Any amendments made to those forms from 2015-2019

APS previously used forms that requested parental consent. This practice was discontinued about six or seven years ago, but did have some limited use in 2015 and 2016. In addition, the SDUPA and policies have gone through several revisions during the window.

It will require approximately 3 hours of staff time to identify the previous versions of these documents. The hourly cost for staff time is $70, so the total cost to provide all versions is $210.

4. Documents outlining any third-party programs or applications collecting student data
The following link lists all currently approved apps for iPads (used in grades K-8). https://www.apsva.us/digital-learning/instructional-software-resources/aps-digital-resources/
Many apps collect student data; however, in many situations that data may remain exclusively on the iPad. It will take approximately 4 hours of staff time to audit every application and determine if the data is stored exclusively on the iPad or if any data is visible to the vendor. Therefore, the total cost to respond to this portion of your request is $280.

In conclusion, the total cost to respond to the remaining portions of your request is $490. FOIA fees exceeding $200 must be paid in advance and are payable by check to "Arlington Public Schools" and should be mailed to the attention of Ms. Jeni Merino, 2110 Washington Blvd., Arlington VA 22204. Staff will commence the work upon receipt of payment.

Please let me know if you wish to proceed with the remaining portions of your request.
