Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

I am looking to access the records for any and all applications and letters appealing for a waiver to the overnight parking ban in Arlington, as well as the decisions and justifications issues in acceptance or denial of these applications/appeals since March 2018.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello Ms. Santorelli,

Thank you for your prompt reply. I was aware of the Select Board's role in granting parking waivers as well and also intended to file a public records request. HOWEVER, the actual section about "Overnight Parking" listed on the Town of Arlington website notes that initial requests for overnight parking waivers need go through the Arlington Police Department and are at their discretion:

"Waivers are at the discretion of the Arlington Police Department. These limited Overnight Parking Waivers are approved at the discretion of the Arlington Police Department and are granted as a courtesy for these specific event types. The APD feels these guidelines will be sufficient for most residents and provides a balance between upholding the overnight parking bylaw and providing some relief to residents. The new process will also eliminate abuses of this courtesy and allow police dispatch to focus on emergency calls and other higher priority tasks."

This past Select Board meeting a individual had filed for a waiver for the overnight parking pass and it was the APD that denied the waiver and seemed to be the body that initially was applied to by this waiver. He then appealed through the Select Board (which also denied), despite that one of his circumstances qualified under waiver I had proposed as a warrant and I believed had been adopted by the Select Board. I am attaching that determination by the APD. These are the kind of records I am interested in, which APD have in their files. To clarify, I need records from the APD of any judgments that have been at their discretion regarding overnight parking waivers since 2018. I am sure you do have some of these records on file. I do not want to miss records that the Select Board may not have on thie rfile because they were applied for through APD (at least as shown above) and for which residents did not then appeal to the Select Board. The Arlington Police Department handles the overnight parking waivers which
you are only allotted 14 days a year.

The Arlington Police Department does not make decisions regarding exceptions
for overnight parking. Officer Corey Rateau provided feedback for the
decision made by the Select Board.

We do not make judgments and therefore do not have the documents you are
requesting. Again that goes through the Select Board and they would have
any emails from Officer Rateau if they asked him for feedback on previous
exceptions.

Exemptions are different from waivers.

In response to your public records request for copies of any denials of overnight parking requests by the Police Department, be advised there are no records responsive to your requests. Single event overnight parking requests submitted through the Town's online Request/Answer Center are considered approved and are simply available to the Police Department in case of a call or complaint of overnight parking. The only exception(s) are overnight parking requests during a declared snow emergency when no on-street overnight parking is allowed throughout the Town.

Requests for multiple days or extended periods are submitted to the Select Board and are subject to their approval/denial.
