To Whom It May Concern:

Pursuant to the Arkansas Freedom of Information Act (“FOIA”), Ark. Code Ann. § § 25-19-101 to 25-19-109, I hereby request the following records:

I am requesting emails and other records of correspondence (including meeting notes, faxes, letters, and memos) sent to or from the following legislative member and their staff members: Rep B. Smith and Senator J. Cooper

I am only requesting correspondence from the above with the following individuals and organizations:

The Center for Security Policy
Christopher Holton (Vice President of Outreach at CSP)
ACT for America
American Public Policy Alliance
Stephen Gele (President of APPA)

Please limit this request to documents generated between these dates: November 1, 2015 - July 31, 2017

If your email search and retrieval system is better configured for keywords searches, you may also search for emails and other communications that mention the above names (i.e., responsive records would be emails from the above legislators that include the term “Center for Security Policy” or “Christopher Holton”).

If you believe that this request is too broad or if you have questions or suggestions to reduce its burden, please let me know and I’m happy to discuss further.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Swathi Shanmugasundaram

Good afternoon.

Please be advised that this email is in response to your request for information related to email correspondence sent and received between November 1, 2015 and July 331. 2017 from the Center for Security Policy, Christopher Holton, ACT for America, American Public Policy Alliance, and Stephen Gele. You have requested this information under the Arkansas Freedom of Information Act.

The public records you have requested either do not exist or are exempt under one of the following exemptions: (1) The "unpublished memoranda, working papers, and correspondence of ... members of the General Assembly..." are exempt from disclosure under Ark. Code Ann. § 25-19-105(b)(7); (2) Some entries do not meet the definition of "public record" as they do not "constitute a record of the performance or lack of performance of official functions", Ark. Code Ann. § 25-19-103(5)(A); and (3) Certain communications between members of the General Assembly and their staff are protected and confidential under Ark. Code Ann. § 10-2-129.

Your consideration is much appreciated.

John T. Vines
