Pursuant to the Arkansas Freedom of Information Act (“FOIA”), Ark. Code Ann. § § 25-19-101 to 25-19-109, I hereby request the following records:

–A list of every hospital, clinic, or other institution that provides sexual assault forensic exams administered by a certified Sexual Assault Nurse Examiner (SANE).

Please note that while I'm using a Massachusetts based public records filing service, I myself am an Arkansas resident.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

I am one of the attorneys for the Arkansas Department of Health (ADH). You have repeatedly requested (apparently automatically) a list of hospitals and other institutions that provide sexual assault forensic exams administered by a certified Sexual Assault Nurse Examiner (SANE), apparently pursuant to the Arkansas Freedom of Information Act (FOIA), in emails dated October 18th and December 18, 2017 (see attached). However, it also appears that you are not an Arkansas citizen. You may wish to reflect on the United States Supreme Court case of McBurney v. Young , No. 12-17 , 569 U.S. _____, 133 S. Ct. 1709 (2013). The Supreme Court , in an unanimous decision , ruled that noncitizens of Virginia could not avail themselves of that state's FOIA law. Arkansas has a similar provision : (Arkansas Code §25 -19 -105(a)(1)(A)). Therefore, your request under the Arkansas FOIA law is denied. In addition, I am not aware that such a list is in the possession of ADH.
