Freedom of Information Request Letter

To Whom It May Concern:

Pursuant to the Arkansas Freedom of Information Act, I hereby request the following records:

• All email communications between Attorney General Leslie Rutledge, her chief of staff, assistant, or scheduler and with Alliance Defending Freedom president Michael Farris, whether in his official or personal capacity, and/or an employee or person acting behalf of Alliance Defending Freedom as an entity.
• Any calendar invitations, calendar entries, meeting agendas, scheduled Attorney General Leslie Rutledge, her chief of staff, assistant, or scheduler and with Alliance Defending Freedom president Michael Farris and/or an employee or person acting behalf of Alliance Defending Freedom as an entity. I am also requesting any informational material such as PowerPoint slides, any notes taken during any oral communications, summaries of any oral communications, of the meetings, should any have taken place.
• Any records of direct messages on messaging platforms (such as Slack, Skype, Zoom, Facebook messenger, WhatsApp, iMessenger or Twitter Direct Message), or text messages between Attorney General Leslie Rutledge or any person communicating on her behalf, such as a chief of staff, assistant, or scheduler and with Alliance Defending Freedom president Michael Farris, whether in his official or personal capacity, and/or an employee or person acting behalf of Alliance Defending Freedom as an entity

Please provide all responsive records from January 1, 2020, through the date of search.

If there are any fees for searching or copying these records, please inform me if the cost will exceed $100. However, I am requesting a fee waiver due to the requested information being for non-commercial and information gathering purposes.

I am providing the following guidance regarding the search and processing of records to better aid the Records Custodian’s search:

• For this request, please include any attachments found with email records within all communications such as in emails and chain emails.

• Please do not exclude records regarding agency business contained in files, email accounts, or devices in the personal custody of your officials, such as personal email accounts or text messages.

• If some portions of the requested records are exempt from disclosure or parts redacted, please disclose any reasonably segregable non-exempt portions of the requested records. If a request is denied in whole, please state why and provide an explanation why such information has been withheld.

• Please take appropriate steps to ensure that records responsive to this request are not deleted by the agency before the completion of processing for this request. If records potentially responsive to this request are likely to be systems where they are subject to potential deletion, including on a scheduled basis, please take steps to prevent that deletion, including, as appropriate, by instituting a litigation hold on those records.

Where possible, please provide responsive material in an electronic format such PDF by email. If the process can be accelerated through the release of responsive records to my person, please also provide such material on a rolling basis.

The Arkansas Freedom of Information Act requires a response within three business days. If access to the records I am requesting will take longer than this amount of time, please contact me with information about when I might expect copies or the ability to inspect the requested records.

If you can identify any ways that my request could be refined, I would be grateful for any further advice and assistance. If you have any queries, please don’t hesitate to contact me via email and I will be very happy to clarify what I am asking for and discuss the request.
