Dear Madam or Sir:

Pima Community College (“PCC” or the “College”) has received and reviewed
your request for public records, specifically a file containing the
university-affiliated email addresses, first and last names of all enrolled
students as of the Fall 2021 semester. The College is unable to provide
the requested records for the following reasons:

- PCC does not maintain the requested information in any single record
or group of records. Providing it would require PCC to create one or more
new records and/or to compile information and data, which Arizona
public-record laws do not require the College to do. *See Judicial
Watch, Inc. v. City of Phoenix*, 228 Ariz. 393, 400 (2011).

- The College is concerned that providing the records would be
detrimental to the best interests of the institution and its students. In
addition to requiring staff and IT resources to prepare the records,
producing the records would compromise the privacy interests of PCC
students and subject them and the College IT systems to unsolicited email
traffic to advance private commercial or financial interests. PCC has
determined that the potential detriment and/or harm to the interests of PCC
and its students outweighs your interest in obtaining the requested
information for commercial purposes. (*See, e.g., Mathews v. Pyle*, 75
Ariz. 76, 81 (1952); *Carlson v. Pima Co.*, 141 Ariz. 487, 491
(1984); *Ariz.
Bd. of Regents v. Phoenix Newspapers Inc.*, 167 Ariz. 254, 257-58
(1991)).

For these reasons, the College declines to provide the requested
information.
